I believe you are justified in this claim. Even though it wasn't cancelled at the time you sought a refund, it was effectively a useless flight as your outward was cancelled. The return cancellation was almost inevitable?
I believe this is covered somewhere in the regualtions but will check later.

I have submitted a claim for the missing flight compensation plus the BA flight via their complaint portal. I will update when I hear something back. Have a nice weekend!0 -
Our flight FR664 BHX to DUB was cancelled (on commotion Weds 27th Sept) and like many people on here I claimed my refund immediately & found an alternative flight with Aer Lingus as we were told we would need to pay extra to get onto one of the other Ryanair flights that day.
After the CAA got involved & told RA that they needed to offer alternative travel for the same cost I then decided to pursue a claim for the £145 difference in flights.
On 29th Sept I logged the claim attaching my new reservation with AL. I called RA on 6th Oct, 13th Oct and again on 6th Nov. On 6th Nov they said that they had issued a refund on 3rd Nov to the value of £439.25 (I wasn't expecting that much!) It was too good to be true however as on 7th November I received an email to say that 'due to a system error a payment was incorrectly made by us' and they then proceeded to take the money back out and send me a letter to state that I had no claim as they offered alternative transport (but that was only after the CAA intervention the following day after they had emailed all of their customers) & no refund was to be issued.
My point is like many people on here - how are they allowed to offer a refund (which was confirmed by the telephone operative on Monday 6th November ) and then take it back out of my account? Is this legal?
And do the forumites think I should again apply for the initial refund or should I get in touch with the CAA (and if so how do I do this?)
On principal now I do not want to let this rest!0 -
I don't know why you would have needed to pay extra to get rebooked onto a Ryanair flight on the same day. Who told you this and do you have it in writing? Either way, if you didn't use your original ticket for the flight that was cancelled you are at least due a refund of the unused ticket + EU compensation (€250) assuming your flight was less than 2 weeks after you were informed.0

The CAA will only refer you to RA's ADR service provider, so you may be better off by asking Aviationadr directly to assist with your claim. They will adjudicate and come to an impartial decision. I believe the service is free.

Does anyone know how long a medical emergency delay lasts ?
About 30 minutes into a flight from Manchester to Lanzarote we diverted to Gatwick due to a medical incident. The Pilot told us it would be approx 15 minute delay whilst the ill passenger disembarked. However after we had landed the Pilot then said we had made a heavy landing and a technician would need to check the plane and also that the crew would be out od time. Given we departed at 06.40am i fail to see how they could be out of time.
We disembarked and were rolling for take off on a 2nd Aircraft at 1.00pm when that flight was aborted due to a technical problem which couldnt be fixed. We eventually departed at 5.30 pm arrivimg our destination at 21.20pm.
Ryanair refuse compensation on the grounds it was a medical emergency but surely those grounds arent indefinite and i would have thought the next scheduled take off at 1.00 pm was the barometer for the further delay.
I would also like to know what happens to the original Aircraft we left Manchester on at 06.40am as i have a suspicion it was used for another purpose. How can i find this out.0 -

I changed it to the 28th Sept as was allowed to reschedule
On the 28th i had a delay of over 3 hours
Ryanair have issued me with a cheque for the delay on the 28th, I have also been contacted by them and they said that I am not entitled to the compensation for the cancelled flight as they only give 1 compensation claim per reservation, this does not seem right to me

Didn't take refund and chose to an alternative flight:
FR3222 28/09 MAN-CRL - This flight was delayed over 3hrs 30 mins0 -
IMO it's two independent compensatable events (assuming the delay was caused by non-extraordinary circumstances) occuring to two different flights. Hence, I see no reason why you shouldn't be due compensation twice.0

Current thoughts are to an extent, divided on this matter.
Your flight was cancelled on 29th, so you should be due compensation initially for the short notice cancellation.
You were then re-booked on an earlier flight (hopefully you didn't pay anything extra?)
The argument is that you actually only paid for 1 flight/journey and the regulations do state that compensation is payable per journey, where a fare is paid that is normally available to the general public.
The counter argument is that your flight was cancelled. Journey over. Compensation due.
Your second flight was delayed >3hrs, separate incident, separate journey. Compensation due.
I suspect this conundrum will need legal/court clarification.
If you had taken the refund and booked yourself a new flight you would definitely be due 2 x compensation.If you're new. read The FAQ and Vauban's Guide
