Flight delay and cancellation compensation, Ryanair ONLY

Sorry if this has been answered above or elsewhere (have tried searching but to no avail)...
We're due to fly on Thursday, but there's a planned strike by French ATC staff which would scupper our flight.
Ryanair appear to offer an option to change your flight if they cancel it. But do they simply provide an alternative flight on a take-it-or-leave-it basis, or can you simply choose your own alternative?
We're tempted to simply make a second booking (and hang the extra £100 expense) if Ryanair's provided alternative flight is at an unsuitable time or to an unsuitable destination.0 -
Dr Watson
Thank you so much for your excellent advice on compensation.
At this early stage all i can say is this has been a real eye opener to say the least as it appears very complicated and very time consuming reading the 1st class Vauban's guide and the posts on this Forum.
I have sent my template letter to Ryanair stating flight number, copies of boarding passes, booking forms, photo of taxi's registration number and taxi receipt(55 Euros) and stated the delay was for over 3 + hours and over 1500km. We have also gave all passenger names , emails etc. I hope i have not forgot anything !
I appreciate this is not straight forward and i will keep you posted. Let the battle begin !0 -

Response from Ryanair within 7 days by email. What do folks think ? chances ? next steps ?
Dear Mr Mcintyre,
I acknowledge receipt of your letter dated the 29/06/2015.
On behalf of Ryanair, we sincerely apologise for the diversion of your flight FR7823 from Glasgow Prestwick to Barcelona El Prat on the 15/06/2015, which was diverted for safety reasons due to an unexpected technical fault.
As the diversion and subsequent delay were for safety reasons and therefore outside Ryanair’s control (extraordinary circumstances*), we regret to advise that no monetary compensation is due under EU Regulation 261/2004.
All possible measures were taken to ensure that passengers were cared for. Our operations department have confirmed that all customers boarded a new flight in London Stansted, which then positioned on to Barcelona El Prat as flight FR782.
Following a review of your receipted expenses please be advised that once a customer arrives in their destination airport, Ryanair has no further liability for any further costs incurred. Therefore, I regret to inform you that we are not in a position to reimburse your taxi expenses following your arrival at Barcelona.
Once again, we sincerely apologise for the unavoidable disruption to your flight.
Yours sincerely,0 -

Nothing to come regarding your taxi fare, RA got you to your destination airport but - over the threshold for compensation under EC261/2004.
They say this was because of an extraordinary circumstance, a safety reason.
Well they would wouldn't they....
It's ESCP Form A time for you.

Hi Dr Watson
A couple of queries about the process.
What role does the CAA take in this ? the Martin Lewis video suggests writing to them as well but also points out if the CAA agree with your claim it is not legally binding.
What are the basic court fees to pay to start the ball rolling ? and what are the estimated costs if we lose the case ? Plus do you have any idea on the timescales ?
Thanks

lonegroover70,
Don't bother with the CAA.
Court fees are dependant on the amount you are claiming, but for an ESCP claim, around £35 to £80.
Costs if you lose- your court fee. RA may try to claim a ridiculous amount of costs in their answer to court but we can counter this.
Timescales - if you get your Form A into court this week, then a written hearing should be happening in around 3- 6 months time.*
*Dependant on the appeal hearing next week in the Barnes case.
My post #569 explains ESCP, Vaubans guide explains all.

FR9803 Girona-Stansted 06/07/2015 0930. The flight was delayed by 5 hours due to aircraft technical difficulties. On boarding, a passenger was taken ill and needed urgent medical attention. All the other passengers were taken off the aircraft and back to the lounge to wait. Subsequently, the passenger (who had suffered a heart attack) died. Eventually the flight took off 9 hours late.
Ryanair have sent out an 'unforeseen circumstances' email apparently shifting the blame for the whole delay onto the deceased.
I will be making a claim using the guides and advice on this thread, but just wanted to bring this 'wheeze' to people's attention.0 -
Rather like the legal exam question we used to get.
A shoots B and kills him. C thinks B is asleep and shoots him intending to kill him but of course he's already dead. What offence has C committed (apart from unlawful use of a firearm)?
The flight was already delayed for more than three hours and the illness of this poor chap is therefore irrelevant except possibly for the length of the delay. RyanAir would have to show that they would have made up two hours had it not been for the illness.0 -
Hi All,
Yesterday I had a flight delay from Alicante to Liverpool of 4hrs 52 mins. The reason for the delay was given as another plane had to land in Alicante due to technical difficulties and our plane was given to these passengers to carry on their journey. Ryanair did not have a plane at Alicante and so one was flown in from Stanstead.
During the delay I recieved an e-mail asking if would like to try and get on another flight to an alternative destination or cancel the flight for a full refund. Both the options given did not appeal and it was easier to wait out the 4hrs 52mins. While we waited one voucher for €5 was given out which seemed like a slap in the face!
Today i recieved an e-mail from Ryanair telling me that no compensation is due as this is classed as exceptional circumstances but surely this does not???
If i click on the link from the main guide it takes me to the Ryanair claims page but the reason given if delayed more than 3 hours with flight cancellation which sounds like option 1 they give in e-mail. As i did eventually take the flight then this option is not valid.
Can anyone give me any advice even if they believe i am due any compensation and if so what is the best steps to take?0
