Flight delay and cancellation compensation, Ryanair ONLY

We were delayed 3 days in Spain in April of this year due to French air traffic control, which is obviously is no fault of Ryanair. The problem I have is not all flights were stranded.
I was on the Liverpool flight due out at around midday which was cancelled. The Ryanair flight to Manchester leaving 30 minutes later still left, as did many other flights that day.
Do I have a case to blame Ryanair? as they obviously to pick and choose which flights were cancelled. We had to find a Hotel, get extra provisions, then were charged extra parking at Liverpool.
fdonovan,
It's a difficult one. RA will for sure cite the ATC strike as the 'extraordinary circumstance' that affected your flight- and this is a genuine EC.
But you say other planes left despite the ATC strike....the difficulty you have is proving that your flight was not affected by the ATC strike and could have left on time and that the reason for your delay appears to be on an operational decision possibly made by RA.
RA would of course have to prove your flight was affected by the ATC strike if you take them to court- if indeed there was one?
My feeling on this one is that your claim maybe somewhat speculative and not an open and shut case- but completely up to you if you want to proceed.
I know what i'd be doing- but maybe that's just me.Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

hi, I just wondered if someone could help. I filled in the template on this site for a delay with Ryanair. The template says that if no satisfactory reply within 14 days, may take it further, or words to that effect.
Well I have not had a satisfactory reply, only a reference and that Ryanair were passing my letter to their Head Office.
So, what do I do now?
CAA here cannot help as the departure airport was Faro, so I have filled out the complaint on the Portugese site. But just wondering, if I am saying I will take it further, I don't know what that further is..
thanks in advance0 -
hi, sorry posted in main forum before finding the Ryanair bit. we were delayed 7 hours in July from Faro to Stansted. No representative of Ryanair was available until 1.5 hours after we had had our luggage go through. So we did not know until they gave us a leaflet that we could have gotten onto another flight to the UK with Ryanair. As it happens we would have done that as quicker. We got 10 euros for food and drink for the whole 7 hours. We did not know we could have 2 phone calls and emails either, until the leaflet but when asked, we were told, sorry no access to do that. We had to get a cab when we finally got to Stansted as too late for pick up or transport as now 2am. My case did not come off the plane for an hour, they had to search to find it, and it was there on the plane with two others. So if that flight had been a turnaround in the day...... So I got home 4am instead of 8.30pm the night before (approx.). I sent a letter from the MoneySavingExpert template, to Ryanair and had an email two days later with a ref to say being passed to head office. nothing since, and that is now 2 weeks. the template says if I do not receive a satisfactory reply within 2 weeks, (or 14 days I think), I will take it further. Just not sure how to do that.
I had to contact the equivalent of the CAA in Portugal as the delayed departure was in Portugal.
I also sent an inmail on linkedin to the Chief Operating Officer and Communications Office for Ryanair but obviously no response.
So we basically had no rights as such (get on another flight), no access to calls or emails and they knew before we even left our hotel that the flight could not be in Faro on time as it had a fault in Stansted and did not take off. They had to fly someone in from France to fix it.
We had an email the day after we got back to say as beyond their control and they tried to resolve, no compensation due.0 -
You need to read thru this thread and Vauban's guide. And I am sure the good Dr will be along shortly to guide you thru the process of NBA, Euro court application etc.
RA are ignoring you/don't want to pay out as exampled by the stock email sent to you.If you're new. read The FAQ and Vauban's Guide
The alleged Ringleader.........0 -
oh for some reason, cannot open that link0

ffiscool,
Like JPears states RA are trying to fob you off with a typical lame excuse.
If you have already sent them an LBA/NBA and their time to give you a positive response is up, then it is ESCP Form A time for you.
My post #569 explains how to sue Ryanair safely using this process.
A good read of Vaubans guide is also essential reading.
Good luck and keep going.Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

Well after 10 months judgement passed yesterday and full claim awarded :j
Don't know much more about the result as just a short phone call to court today so awaiting official letter
Of course Ryanair still have to pay up and I do think that this is a case that their solicitors have let slip under the radar so wouldn't be surprised if they appeal etc
Will keep you updated0 -

JJ_K,
Well done!:j:beer:
It has been a while coming but you stuck rightly to your guns, and kept going.
That's exactly how you deal with this airline and their solicitors.
Do keep us updated.
