Hi All,
Yesterday I had a flight delay from Alicante to Liverpool of 4hrs 52 mins. The reason for the delay was given as another plane had to land in Alicante due to technical difficulties and our plane was given to these passengers to carry on their journey. Ryanair did not have a plane at Alicante and so one was flown in from Stanstead.
During the delay I recieved an e-mail asking if would like to try and get on another flight to an alternative destination or cancel the flight for a full refund. Both the options given did not appeal and it was easier to wait out the 4hrs 52mins. While we waited one voucher for €5 was given out which seemed like a slap in the face!
Today i recieved an e-mail from Ryanair telling me that no compensation is due as this is classed as exceptional circumstances but surely this does not???
If i click on the link from the main guide it takes me to the Ryanair claims page but the reason given if delayed more than 3 hours with flight cancellation which sounds like option 1 they give in e-mail. As i did eventually take the flight then this option is not valid.
Can anyone give me any advice even if they believe i am due any compensation and if so what is the best steps to take?

Yes compensation due, your aircraft was 'sacrificied' to service another flight. This is an operational decision made by RA and is not an extraordinary circumstance.
My post #569 explains the process you need to follow to recover your compensation from RA.

The case that my case is stayed on should have been heard yesterday, I have just rang the Court for an update and it has been adjourned for 6 months! I asked if the judge would have another look at my application to have the stay set aside but was told I would have to pay an application fee again!0 -

This is disgusting behaviour from our legal system and of course Ryanir. With I think ALL OTHER airlines now paying claims? (someone correct me if I'm wrong.) why Ryanir are still trying to get mileage out of Van der Lans is beyond my comprehension.
Problem is if you pay another fee (I think it's £150) to try to get the set-aside then there is absolutely no guarantee that you will get your stay lifted.
I don't know what else to suggest, just grin and go with it and hopefully interest at 8% when it's all over will make up for it. It will be interesting to see what the Dr s advice on this one is. I'm stumped!

Is this the Liverpool County Court appeal ryanair had put in against the decision in Barnes vs Ryanair?
I was waiting to hear on that too, very annoying if it has been delayed for 6 months! They've already had the appeal rejected once!0 -

Novice, I can't agree more. It is. You could say that RA play the game well, but you wouldn't if you were a litigant held in limbo because of all of this. RA of course have effectively got 'on hold' all cases where a tech fault is being used as their excuse not to pay compensation because of this....and we all know that in the majority of claims 'tech fault' is claimed by RA.
Where we are from we'd say that RA are 'playing a blinder'.

So, what next for our litigants awaiting the decision in the Barnes case?
Do check with the court that the case is in fact adjourned for the timescale mentioned and ask why? If your case is stayed because of the Barnes case, you are entitled to an official reason why the case is adjourned and when it is likely to be heard- so ask for it.
Then, sit and wait.
Your case is still pending determination on the outcome of this appeal hearing, any ruling in the attributed KLM V VDL case may decide this if, this happens in the apparent adjournment of six months, so keep your eyes on here, and contact your court directly say once a month for an update on when the hearing will take place in the Barnes case that your case is stayed upon.
If you are a potential litigant and are 'holding back' starting your claim against RA dependant on the decision in the Barnes case....don't hold back.
Get your claim started and get it into the system straight away, decision in the appeal may be some months away, it may not, and a decision in KLM V VDL maybe more but, once your claim is in, then it's in.
And believe me when your case does goes to court a vociferous and reasoned argument will be presented to persuade the courts that 8% interest should be awarded.
Justice delayed is Justice denied.

We were delayed 3 days in Spain in April of this year due to French air traffic control, which is obviously is no fault of Ryanair. The problem I have is not all flights were stranded.
I was on the Liverpool flight due out at around midday which was cancelled. The Ryanair flight to Manchester leaving 30 minutes later still left, as did many other flights that day.
Do I have a case to blame Ryanair? as they obviously to pick and choose which flights were cancelled. We had to find a Hotel, get extra provisions, then were charged extra parking at Liverpool.0 -
