  • No we don't have it in writing it was a verbal offer on speakerphone and witnessed by 5 people we also have the name of the girl who said our Taxi would be refunded. Our delay was caused by Flybe giving our plane away at the last minute. The local radio station broadcast our plight live on the day and we think it was a save face offer from Flybe as the Rugby final was big news here.

    That taxi refund sounds suspicious. The airlines have taxis that they can use for situations like that which are contracted as mentioned! No matter how many people witnessed it, if you got nothing in writing and the girl had no permission to authorise it then you may not see that again sorry!

    I had a flight cancelled on Friday, was supposed to be heading from Jersey to East Midlands at about 3pm.

    After we had checked in, been through security and bought our duty free, we noticed that our flight was on the screen as 'delayed'. A few minutes later an announcement came over the speaker saying that our flight was cancelled and to take our duty free back and to head back to departures for more infotmation.

    When we went back to departures, we were told that there was a 'technicial problem' and they could offer an alternative flight to Southampton and a coach up to East Midlands. As we needed to be somewhere we had no choice but to accept this (as there were no other flights to airports nearby). The coach (which turned out to be a couple of taxis) took about 4 hours which got us there around 9pm instead of 4pm the original flight would have.

    Since returning, I have checked FlightStats which shows our flight as being cancelled at 6.18am!!! Now I'm no expert on this flying business, but if they knew the flight was cancelled at 6.18am, why were we not informed? They allowed us to check in, go through security wait in the departure lounge until 3pm when they decided to tell us.

    If we had been informed earlier we could have made alternative arrangements and flew to Liverpool, Birmingham or Manchester and got to our destination far earlier.

    Would I be entitled to compensation for this? I'd never choose flybe if I had a choice but they have the monopoly over certain destinations from where I live. I'm just glad their Gatwick route has been taken over from the much more reliable easyjet!!

    The short answer is probably. It depends on the cause of the cancellation although, given that you say it was a technical fault, it is likely you qualify for compensation of 250 Euro per person based on the flight distance. A recent CoA case has strengthened the position of passengers when airlines cancel for technical faults. You need to write to the airline, claim compensation in line with EC261/2004 and suggest that if they feel compensation is not due they should explain why, specifically identifying:
    1. What was the ultimate source of the technical fault?
    2. Why they consider this source to be out of the ordinary and not inherent in their normal activities?
    There may be template letters on this forum or MSE website. With regard to your other issues, I agree poor information is a real problem unfortunately getting some kind of compensation for this is far more problematic. The 250 Euro I spoke of is statutory compensation for delay/ cancellation the airline is also obliged to:
    1. Offer reimbursement/ refund or re route under comparable transport conditions
    2. Provide written notice of your rights
    3. Provide meals/ drinks appropriate to the length of the delay
    4. etc. All in EC261/2004
    I suppose you might argue breach of contract ie you have a contract of carriage (by air) and you ended travelling in part by coach and this isn't 'comparable' rather it is simply more convenient & cost effective for the airline so you could ask for a refund or part refund as well. You can always ask. Afterall the over arching principle of EC261/2004 is to reduce the inconvenience to passengers!

    Sometimes flightstats doesn't get it right - so I wouldn't worry too much yet about when they knew that the flight was cancelled. As you were over three hours late in arriving at your destination, compensation is owed. See the FAQs on page one for how to claim.

    You were only 2hours 12 mins late you wont get any compensation as it has to be over 3 hours

  • Ok,I think I may have got confused by the fact that there was a cancellation of the flight we had booked,and we arrived at our destination over 2 hours after our original ETA .
    Oh well-nothing ventured, nothing gained!

    Anyone here also in Amsterdam-Southampton flight last weekend 03-July 2014. We have been delayed for 276minutes (that is more than 3hrs). I am writing a claim to Flybe. Will post the letter tomorrow and all other supporting docs like receipt and boarding pass. We were family of 5 (4adults +1-infant) not sure if my 8mos baby is also entitle to €250 as we only paid €30 for her ticket. I am claining for 5 persons anyway in my letter. I use the template provided here btw.
