  • Hi Guys,

    so 8th July my 7.30am flight from BHX to Glasgow was cancelled within an hour of boarding. (BE782) the next available flight was 5 hours later, which I didn't take as I was going to Glasgow for a 9am meeting.

    wrote the letter to flybe and posted it recorded, and they emailed me today (which is strange would have thought they'd have sent a letter) which took them the 28 days.

    the reason for the cancellation : lightning strike. ergo - no compensation whatsoever.

    now i'm not being funny and as a PPL pilot myself, the 3 days running upto this flight we had great weather so I don't know where this plane was coming from to be struck by lightning, I heard Ireland, but was only hearsay at the airport on the day.

    Do airlines normally lie this outrageously? This is my first time chasing a claim.

    I've referred this to the CAA to get the airline to provide documentation that it was due to a lightning strike, there should be meteorological data to back this up, or some kind of evidence.

    just seems far fetched... especially on a plane route that has had 4 cancellations in 4 months! and is one of the worst performing routes in the fleet!

    very disappointed with their email though, after gloating they do not have to pay compensation they went on to say:

    Thank you for taking the time to write to us allowing me the opportunity of response and we look forward to welcoming you on board our services again soon.:rotfl:

    a bit presumptuous I think that one???

    In reverse order ... normal recommendation is to not waste time with CAA.


    Yes airlines do lie ... even in court!


    If meteorological problem it should be with regard to your flight not a prior one.

    I was meant to be on a flight from East Midlands to Glasgow.

    The late arrival of the aircraft meant that the captain was then over his hours and he couldn't fly. One of the ground staff mumbled something about bad weather in glasgow was responsible for the delay in the aircraft arriving.

    Would this be seen as extraordinary circumstances?

    My 8pm flight ended up as a 12.30pm flight the following day.

    And don't get me started about the length of time it took to get a hotel!

    If the delay was due to weather then this would be extraordinary
    You can check on flightstats and see whether there were other flights affected for Glasgow Airport on that date

    My partner and I were on the same flight as you. We ended up cancelling all together as the 12.30pm flight on Saturday was too late for us to get to a wedding in Glasgow.

    I've just sent off my claim for compensation to FlyBe, it was quite a hefty document leaving nothing open to doubt. Weather cannot be used as an excuse for this flight. I looked at flight data at both East Midlands and Glasgow on the Friday evening and BE558 was the only cancelled flight at either airport, and this included flights from London/Birmingham/Leeds - all of which would have passed through similar airspace en-route to Glasgow.

    I'll update when I hear back from them.

    Many thanks for your reply - and to the previous poster. Interesting information about the weather.

    I will also send off the compensation claim, also including my displeasure at having to wait hours (with a very obviously broken foot!) before a member of staff deemed it necessary to make the 20 second phone call to book a hotel.

    I will also update once I receive a reply.

    Not sure what to make of this? I've included the full email below:

    "Thank you for your e-mail dated the 30th July 2014, regarding your flight with us on the 14th December 2011.
    I am sorry to hear of the delay that you encountered on your flight. I have looked in to your booking and can see that flight BE428 on the 14th December 2011 was delayed 3 hours and 5 minutes due to the aircraft you were due to fly on having to be swapped due to technical difficulties.

    Regarding your claim for compensation, as you may be aware on the 11th June 2014 a case similar to yours was heard in the court of appeal (Jet2 v Huzar). The ruling was found in favour of Huzar and as a result the case is now being referred to the Supreme Court of Appeal.

    Until the matter is determined by the Supreme Court we will stay your claim which arose as a result of technical difficulties. For clarity we intend to handle your correspondence in one of the following ways -

    1 - If the appeal is refused we will write to you in line with the most current ruling under the EU Regulation 261/2004.

    2 - If it is decided that the case is to be heard by the Supreme Court of Appeal we will write to you following the final ruling.

    You need to do nothing further and we will hold details of your claim on record until a decision is made by the Supreme Court. Please be aware that this could take some time and the court is unlikely to make a decision on whether it will accept the case in the Supreme Court until later this year.

    There is a 6 year limitation period on UK claims; however as you have written to us within this period we will still consider your claim, even if the 6 year limitation period expires between now and the Supreme Court decision.

    In the meantime we offer our apologies for the disruption that you have experienced and we would like to assure you that we will be in contact in due course following the decision made by the Supreme Court."



    Are they allowed to do this and what does it mean for the success of my claim?

    Hi, wondering if I can ask for a little advice please?

    We should have flown Flybe flight BE7214 yesterday from Dusseldorf to Manchester at 10.20am. (We had flown in from Chicago and this was to be our connecting flight back to Manchester). We were put on first alternative flight which left Dusseldorf at 5pm and landed in Birmingham (Manchester flights were fully booked) and they taxied us back to Manchester

    Can we put in a compensation claim for the cancelled flight?

    I have downloaded the letter (thank you)

    Do we have to get an accurate distance from Dusseldorf to Manchester?

    Also it asks for the number of days / hours before the flight was cancelled before flying. I am not sure when the flight was cancelled as no one told us but have found this information: so not sure what to put.
