Dealing only with Tyzap's comments about the conversation with the BA representative, Courts frequently have to deal with a situation where one party to a conversation says something and the company fails to produce the other party to that conversation. It is not up to you to identify that person, but BA and to produce that person in Court. If they fail to do so, the Court will probably accept your account especially if your subsequent actions were in accordance with your account of what the representative said. So go for it.0

Hi all,
Delayed for 2 hours at San Francisco going to Glasgow connecting via Heathrow,resulting in missing the glasgow flight total delay in reaching final destination of 3 hours and 45 minutes.
Is the compensation on the uk part only.

Was it all on one ticket if yes it will be the whole trip and because it is under 4 hours compensation will be 300euro per person0

BA are refusing compensation based on the grounds that they were only responsible for 167 minutes of the delay. The below is what they have said:
I’ve had a look at the information we have about your flight and it was delayed 167 minutes because of a rotational delay. This was due to the previous flight having a technical issue. Unfortunately, this required the aircraft to be changed. There was then a further delay in starting up the aircraft. Due to airfield congestion flight was then delayed taxiing in to position.
I understand you're wanting to claim compensation for your delayed flight. Your claim for compensation has been refused because we were only responsible for 167 minutes of the delay. Under EU legislation we will only pay out compensation if we were responsible for 180 minutes of the delay.
Should I pursue this further as they were responsible for the majority of the delay and the congestion would not have happened if there wasnt a previous delay.0 -
Yes.
167 minutes (and they will be being very conservative with that figure) out the minimum 180 minutes required for a delay claim, is clearly the cause of the delay.
BA's argument is specious to say the least.If you're new. read The FAQ and Vauban's Guide
