Flight delay and cancellation compensation, BA ONLY

    Got an email from BA on Tuesday saying my scheduled flight home for Thursday (yesterday) was simply cancelled. No other info, just straight up cancelled.

    They automatically booked me onto another flight with a 5 hour layover which I refused, and after spending hours calling them up, they managed to book me onto a different, but direct American Airlines flight home.

    I submitted a compensation claim through BA's website already.

    Considering the extremely short nature of the cancellation, am I entitled to full rate compensation under EU law?

    The BA rep on the phone suggested (but didnt confirm) that it was likely due to a technical fault with the plane as it hadn't made the previous flight it was scheduled for either.

    Any advice here would be great. TIA

    What were your original flight details, flight numbers date etc, and how many hours late did you arrive at your destination?

    Further to my long post at #1947, on Wednesday of this week, BA simply paid the £1,057 (1200EUR) into my bank account along with a separate payment for about £22 for the lunch bought at JFK.

    No questions, just paid it! Then 2 days later an email saying much the same, and apologising for the delay, LOL.

    Was expecting them to be very slow and argumentative, but at least in this regard they have done the right thing and fairly quickly.

    2 weeks total from claim to payment.
    I didn't do it, nobody saw me do it, you can't prove a thing! ;)

    Technically I arrived early as they put me on an earlier flight, thus cutting into my actual holiday time.

    Was meant to land at around 7am on the 25th (today) but landed at 10pm on thursday 24th (last night)

    No, but you're due 50% (assuming no extraordinary circumstances) since they you got home without a delay.

    I am currently in the process of taking an airline to court on this very point. Their defence is that a queue for de-icing in cold weather is an 'extraordinary circumstance' - whereas there actually appears to be past cases that the airlines lost - found in favour of claimant - because the court felt this was an operational issue.

    Presumably the court felt airlines should have more control of the de-icing especially when cold weather is predicted days in advance.

    I'll let you know my result but if anyone feels they wish to cite any cases you see about this, please do so. I know of one so far where it was held as above but for the moment I must keep my powder dry. Sorry.
