    Just an update on my previous posts in this thread.

    I sent off a hardcopy letter on around end of Feb to BA, and I got a reply this week to say that I was eligible for compensation and that payment would be sent separately to me.

    Thanks again to MSE for highlighting this

    Claimed compensation mid Feb via BA website, chased customer services about 10 days ago, got an email over Easter to say cheque is on it's way! Result! Thanks to everyone, particularly Centipede for their help!

  • Hey everyone, here is a brief summary of what happened. I've put my claim into BA a few days ago, so was wondering if anyone is hopeful.

    I had two flights cancelled. The first was from Newcastle to London. This was cancelled and myself or my friend I was travelling with were not informed. We only found out about 20 hours before travel. So we had to get the train, which cost a pretty penny, in order to make our flight from Heathrow to Arizona.

    Upon returning, our flight from Arizona to Heathrow was cancelled. Again, we weren't told, we found out by checking. The alternate flight was from Arizona to Texas, and then Texas to Heathrow, but it was much earlier (almost an entire day) so we lost time on our trip.

    We believe this was all due to the strikes.

    Are we entitled to anything?

    You may be if there was a strike affecting a previous flight which then caused your flight to be rescheduled or cancelled (Case C-22/11 Finnair Oyj v Timy Lassooy).
  • How would that work? BA caused the strike by not come to an agreement with the Trade Unions. Surely they're both responsible and accountable?

    I'm not sure if my flights were cancelled due to a domino effect. I'm not sure how I would know that.

    I think if I get knocked back I will just follow the process through to the end, just to make sure every governing body agrees that we are not entitled to anything.

    If an air traffic control strike prevents an aircraft leaving, it's not necessary to analyse whether the airline could have been more generous in its negotiations with a trade union. ECs would apply to flights directly affected.

    The Civil Procedure Rules require the airline to be completely transparent and cooperative with you in providing all the evidence you would need to decide whether or not to bring a claim, both before you issue proceedings as well as after. This includes evidence harmful to their defence. Cost sanctions are available against defendants who do not cooperate with this process, even in the small claims track, under part 27.14 (2) (g).
