    So it's now been 8 weeks since my complaint and 3 weeks since I sent my NBA - I have decided to see it CEDR will get more joy out of Thompson before I take them to court.

    I have never seen such an evasive company in my life!

    I suspect they're a) they have a huge backlog of claims and too few staff to deal with them quickly; and b) they prioritise their attention on those who actually take them to court.

    CEDR still ought to be a quicker route to getting paid than court would be, but be aware there's a fair bit of evidence that even if the adjudicator finds in your favour, Thomson are still unresponsive.

    If that's the case whats the point of CEDR! (or why are CDER handling their disputes if they are ignoring it) - Do you think I should just issue court proceedings then? Indeed can I now it's with CDER?

    Does anyone know how long CDER take, currently it says they have 15 days just to assess if my complaint is something in their remit that seems slow to me?

    I was hoping this be sorted by Autumn, I'm thinking Xmas now!

    Gavvy. Thomson will take as long as you let them. They have a huge backlog of claims and an insufficient number of staff to handle them. If you want to press matters forward don't bother with CEDR. Download Vauban's guide, issue an NBA and if they don't comply, sue them.

    Well after a discussion with the other half and a glass of wine I have downloaded the guide and filled in the forms and will post tomorrow,(can't do online as there are 2 of us) The NBA was sent on June 30- so they have had way over 14 days, and they are now outside the 56 days they originally quoted me in the auto reply from when I filled the complaint online. I have messaged CEDR and told them not to bother.

    They should refuse Thomson claims if they are not adhering to their decisions.

    Well looks like I have no option but to take them to court

    CEDR ruled in my favour- and has since been ignored with no correspondence or follow up.

    Submitted my claim directly via Thomson's facility, heard nothing.

    CEDR at least gave me the confirmation I needed that I would win a case in going to court, but clearly this is all they're doing as Thompson just ignore any rulings they are making.

    Have you spoken to CEDR and asked them to enforce their ruling? What have they said they will/can do about it?

    It is part of Thomsons agreement with CEDR that they will abide by CEDR's findings, it really is up to CEDR to sort this out, and you should push them to do so. You could threaten to report CEDR to the CAA for none compliance. I recommend that you push them all the way before using the safety net of MCOL.

    I wouldn't threaten to report CEDR and Thomson to the CAA. I would report them immediately. Thomson are simply ignoring CEDR's rulings and their attitude makes a mockery of the whole concept of ADR. CEDR ought to be expelling Thomson from their scheme but, of course, they are making lots of money out of it.
  • Hi I have recently had success with CEDR, Thomson replied straight away and offered me compensation i have not received it yet, but this is a slow paying up tactic which Thomson Airways apparently always do its been 3 weeks since they offered compensation, so it goes to show that CEDR do have some success
