Hi I have recently had success with CEDR, Thomson replied straight away and offered me compensation i have not received it yet, but this is a slow paying up tactic which Thomson Airways apparently always do its been 3 weeks since they offered compensation, so it goes to show that CEDR do have some success

So they've offered me compensation for 3 people at €400 each but there was 5 of us including infant in email they said don't pay for free child places and infants even though infant paid surcharge and child places weren't free I've already sent my claim form into county court for full amount will I just continue claim and explain they paid some after I sent form in I've had no responce from court yet as I only sent it monday any advice on this conundrum appreaciated0

From Solicitors Bott & Co website...
You can claim for an infant as long as you paid something for their ticket. This applies even if they didn’t have their own seat and even if you only paid a small amount for their ticket.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Yes I thought that but I've already sent form n1 in before they offered me will I have to inform the court when my claim is processed that they have paid part balance etc thanks0

Hi, I'm new to this site so please forgive me if I'm wrong to 'jump in' with a response.
I have used CEDR to assist me in my claim for compensation following a 7 hour delay in Iceland, culminating in me needing a wheelchair due to exhaustion, I have MS, plus alternative transfer from Manchester Airport. Their adjudicator awarded myself and three persons travelling with me, €1600 at the end of May.
I am still waiting!!
I have phoned and emailed Thomson asking them where is my compensation-indeed it was a senior customer support advisor at Thomson that recommended I refer my case to CEDR!
Today they finally contacted me with the advice I need to liaise with CEDR!!
I appear to have entered 'twilight zone' and going round in circles.
Whilst I appreciate their assistance in the matter, I don't really understand the point of Centre for Effective Dispute Resolution, when the airlines simply ignore their decision!!
I guess I'm going to have to start Court proceedings!
This is difficult for me due to my disability, but I can see no other avenue to 'go down'
Of course, by all means contact CEDR, but I'm not holding out much hope on receiving this money unless I go to the Small Claims Court!0 -
You need to send a strongly worded letter to the CEDR stating Thomson's refusal to pay despite the adjudication asking what they are doing about it. You will see from previous posts this is far from an isolated case.
You should also write to the CAA with a complaint. The latter probably won't help you personally but if people do give evidence about airlines' non compliance, there is just a chance, slim mind you, that they may dosomething about it.
Send letter to Thomson demanding payment within 14 days, marking it as an NBA or LBA . You are then free to start court route after 14 days.

As JP says, you should be escalating this with CEDR, not chasing shadows with Thomson. Push CEDR to do the job they are contracted to do, tell them you will send a letter of complaint to the CAA if they do not get your money PDQ.

Thomsons were one of the cases highlighted by BBC Watchdog last night when they have a whole crowd of people who had used ADR, including CEDR and found the airlines ignored them after the awards were made.
Needless to say Thomsons did not admit they were overwhelmed with claims, which it seems they are, nor did they admit they were intentionally delaying paying out but they were 'mistakes' It does seem at present CEDR is not having any effect on the 4 airlines it carries out ADR for so complaining to the CAA may be the only way other than legal action, which itself may not be that quick either.0 -
Bear in mind the CAA has no teeth and cannot force an airline to payout.0
