We wrote back to Thomson disputing their reason for rejection and have had response via Resolver referring us to CEDR which has started handing flight delay compensation claims from 1 February 2016, but only initially for Thomson. We have submitted a claim to CEDR today and will post a further update if/when we receive any response. CEDR info is via cedr . com / aviation
CEDR acknowledged our claim straight away and said they would confirm within 15 working days whether our dispute fell within the scope of the scheme. E-mail received on 8th March advising that CEDR would be writing to Thomson and giving them 14 calendar days to respond. Today (10th March) response received from Thomson via Resolver stating "Having reviewed your case in line with the Arbitration process, in this instance Thomson Airways is not claiming extraordinary circumstances and you will be paid the appropriate amounts of compensation in accordance with the Sturgeon ruling" and confirming that a cheque for £628.62 (EUR 400 x 2) will be issued within 28 days. :j0 -

Hi everyone I was delayed for 7 hours in Mauritius in January of this year due to Thomson having no crew to fly us home. I wrote to Thomson when I returned home and have just received a cheque for £1888. No quibbling from Thomson just a letter saying sorry. It doesn't always take forever0

I believe I was on the same flight as you, I have also written to Thomson via their online claim form, but have had no response and the 56 days they request to respond is due tomorrow, could you confirm how you contacted them to get your claim accepted?

Sweats, just because they say they need 56 days to reply, doesn't mean you have to allow them so long0

After a year of trying I have now heard from Bott & Co that Thomson are paying up for a delay in December 2014.
I initially wrote to Thomson myself who cited adverse weather conditions on a previous flight and hence exceptional circumstances.
I then contacted Bott & Co who initially refused to take my case on. This in itself made me think twice about court proceedings.
I tried using resolver but Thomson were adamant they were not going to pay up.
I again considered court action but decided against it. I'm sure the airlines rely on this a lot.
Then I received an unsolicited email from what I thought was another claims company. I thought what the hell and submitted my details. To my surprise I then got an email from Bott and Co saying they would take my claim on.
This was five weeks ago. Yesterday I got the email that Thomson had caved in.
I know people will say I've lost out by not doing it myself but at the end of the day i will be getting something so I'm pleased with the outcome. it pays for another short break so happy days.0 -
about the 6 years limit for claims.
I claimed for a delay for a flight on 23/03/2010. The result was it was turned down by Thomsons due to technical problems.
Having watched a recent programme by Martin saying that most of these technical problems have been thrown out by the courts, I have now re applied for compensation for this delay, which i did on 10/02/2016 about a month before the 6 years deadline.
They say it will take 50 odd days to look into(automated response) by which time i will be over the 6 year deadline.
Now if they once again come back to me refusing to pay out then it will be too late to go through the likes of Bott & Co for greater leverage on Thomsons.
Question. Would/should I go straight to Bott & Co now whilst still inside the 6 years or let Thomsons take the lead.

It is unlikely Bott or any other NWNF will take this on so close to the deadline
You need to have got your paperwork into the court before the 6 years is up
If you issues a NBA on the 10th Feb then get it in now/today (Vauban's guide will help)
If you leave it with Thomson...I would think there is a very high chance of them coming back to you after next week to say "too late"
I am not sure whether you can take it to the court if you have not issued a NBA and ultimately you could be too late to do anything...you have till Tuesday0
