I agree that there is nothing either in the Regulation or subsequent case law that says knocks ons cannot be extraordinary. There is a particular example for weather which suggests they cannot be, in that context only. The knock on point is really address by the Third Question of the Wallentin Judgement, IMHO.0

My flight was delayed, 4.5 hours late on arrival to Orlando in June 2011. It was due to a malfunction and we had to change planes. I applied for compensation a year later, and was knocked back by Thomson, extraordinary circumstances etc etc. After the ruling in the European court, I applied again in February via this site. Today, out of the blue in the post (no emails) a cheque for €1200. �� I was expacting another NO response, courts etc etc... Chuffed...0

Hi, guys. I filed a claim with Thomson on the 6th of Feb this year regarding a flight delay we had all the way back in 2011. This mornings post brought a nice surprise, a cheque for little under £1600. Which equates to 400 euros each for me and my 4 friends.

I am using Resolver and sent first letter to Thomsons on 17 Feb 2016.Received ack from them saying wait 56 days. Wrote again today, 15 April 2016, to say I am still waiting to hear from them and have received the same ack letter saying wait 56 days! I want to escalate and not sure who to go to.0

Anyone else trying to claim compensation from Thomson for a 6+ hour delay on the flight from Barbados to Birmingham ? I've gone down the Resolve route and both my wife and I have had rejections from Thomson, one wrongly quoting crew illness as an exceptional circumstance and the other alluding to a 'reactionary knock-on effect'. I believe one of the crew was ill on the down flight from Birmingham the day before, but can't believe Thomson can escape their inability to source a replacement aircraft/crew in a shorter period. Our captain said our delay was entirely a result of being unable to get the designated replacement aircraft due to it being out of service. They had to get a plane from one of their European partners. I have now lodged a complaint with the CAA, but they don't seem to be able to do anything but ask Thomson to reconsider my claim. Surely there are more than me and my wife on that flight who feel extremely angry about this. We must not let this drop.0

EUclaim state you are entitled to 600euro compensation per passenger. Read Vauban's guide and issue a letter before action. All explained in the guide0

just to let you all know- i have after a long process finally received a 300 euro refund each relating to flight thom 92 to cancun on 27/02/2014- this was after going through the template letter to the CAA via this website many thanks to you all N Brewer:beer::beer:0

As a very Happy Bunny, I thought I would share with you my good news!
I initially wrote to Thomson's on 29 Jan 2014 about a 10 hour flight delay to Cancun, Mexico in Jan 2011 for two people. Their response on 11th Feb 14 was that my claim was outside the two years allowed by UK courts. The CAA were no use either almost agreeing with Thomson's.
Anyway, I waited until I could quote the "Supreme Court Ruling" and re-submitted my claim on 19th Feb 2016. My letter went unanswered, so I sent a further claim on 14th Mar 16 by Registered Post giving them 7 days to respond. Again, no response was received , so I submitted my claim by Small Claims Court (£60 fee). Thomson initially wrote back to say they were intending to defend the claim, so i thought I would have to go to the next stage.
To my delight, this morning I received a cheque in the sum of £942.46 - I know by doing this, they have avoided paying me my £60 court fees and interest but this was cheaper than me paying a Solicitor to submit a claim.
Now to book my next holiday! :-)0
