Flight delay and cancellation compensation, Tui/Thomson ONLY

Hi , I had a flight delay of 28 hours in July 2008, I tried several times between 2008-2013 trying to get flight compensation , however was told it was technical error and despite going through the CAA and the aviation authorities in Portugal never received compensation. When the new ruling took place in June 2014 I tried yet again knowing that they was a back log , I contacted Thomason several times over the last several months and have the email response from Thomson confirming this but I never heard anything back regarding my compensation. I have today rang Thomson to be told nothing on file and also I am out the 6 year window.
I am so frustrated as I have tried and kept all my proof and now Thomson are stating the 6 year ruling when I tried several times.
Please help or advise as no solicitor will take this on.:(:(:(0 -
The compensation is the same, but the duty of care differs. At least now the airline has to provide overnight accommodation.
You also had the right to cancel and receive a refund for the flight element of your holiday after you've been delayed for 5 hours, (although how much that is in £s is bit of grey area if you've booked a package). Your insurance would probably have let you cancel the package after 12 hours. At that point if it was us and we were only going for a week we would just cancel.
The last long delay we had we got around £7 to cover 12+ hrs. How on earth did we manage before EU261 was dreamed up lol.0 -

2008 is outside the statute of limitations which is why a solicitor wont take it on. If you had started court proceedings within the 6 years, even if they were started and stayed, it would have been a different matter. Even in June 2014 you only had a month left.0 -
Six of us flew back from Mauritius to London Gatwick on 2nd Feb 2015. The incoming flight was over four hours late , but we were given no reason , no information , no food and drink , and no details of our rights. The fight TOM059 eventually arrived in Gatwick 3hrs 20 mins late. We claimed using your templates and Thomson rejected our claim. We wrote to the CAA who confirmed that our claim was valid. Thomson again rejected it. We then took the case to the County Court. Thomson did not appear , and we won the case , and Thomsons have now paid up - £1482. Thank you to moneysaving expert for advice which enabled us to do this ourselves. Anyone else on the flight should claim also !!0

Just wondered if you got anywhere with your claim?
I was on flight TOM86 on the 25th april 2014 (Friday), it was delayed a total of 394 mins, told at check in that our plane was hit by lightening on the wednesday.
I sent a claim in and was told plane was delayed due to exceptional circumstances (weather) therefore we dont have a claim, so I didnt pursue it.0 -

I was on both of those flights too with my family. Got the same reply from Thomson when i tried to claim so didnt pursue it.... Did you ever get anywhere with yours?0
