I personally would bother with the CAA, I'd write the NBA, and when time is up start legal proceedings, if you haven't already read it, just follow Vaubans excellent guide.
Cheers,

Yes. It's a valid claim. It's up to Thomson to sort out their staffing levels and if they work so tightly that a one hour delay puts a crew out of hours that is down to them. It is an operational failing0

NoviceAngel - thank you i will go home and study Vaubans excellent guide tonight.
legal magpie - thank you for confirming it is a valid claim, another question if i may, does it affect the claim that Thompson put us all up in a hotel overnight during the delay ?
Also as we missed our pre arrange transport from the Airport to our house the day before, and had to pay for addional transport costs, the next day after the delay, im thinking this is not something we claim for, as its only the flight delay we can claim for ?0 -

No the least they have to do is to feed you and make sure you have somewhere safe to stay overnight, does NOT make any difference to a delay claim.
You could try to claim extras by providing proof and receipts, personally I wouldn't bother unless these losses are high, don't forget you're taking hundreds of Euros in compensation. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

thank you , the additional next day travel costs were just less than £50 so it maybe best to drop that claim and concentrate on the flight delay compenstation only then.0 -
Quick update.
Case transferred to Liverpool, Judge Baldwin. Thomson have until 4pm on the 8th (might be the 12th, at work so don't have the form with me), to come up with a defence they intend to rely on or the judgement will be made in default.
This looks like progress to me, although I fully expect them to mess about some more.
Thoughts anyone?0 -
Doris, this is good news. Don't get too excited about the deadline for the defence as they rarely miss deadlines. Most most courts have a backlog of paperwork but they date stamp everything so the Court may well get it in time but it may take a few days (or even more) to process.
They will probably put in a defence but if it's the same as before, nothinhg to worry about. Just press on.0 -
As ever, I am in your debt.
Cheers.0 -
I am just starting to write my NBA to Thomson, one question though, is best to print off all the resolver emails that i sent Thomson, and the auto replies back from Thomson from the last few months along with copies of my boarding passes and send them with the NBA ?
thanks

It will do no harm but it will do no good either. Thomson won't do anything until they have to, and they already have the previous documents. Send your NBA and if the deadline passes without a response issue proceedings0
