Flight delay and cancellation compensation, Tui/Thomson ONLY

I did the same! There have been cases however where claims on behalf of multiple claimants via MCOL have been restricted to the lead claimant.0

Our party of 9 was delayed for 11.5 hours on a Thomsons Airways flight TOM742 from Glasgow to The Dominican Republic on 25 June 2011 due to “extraordinary circumstances”. Thomsons refused our claim for compensation and ended the exchanges on 11 December 2013 with a terse “any further correspondence received will not be responded to”!
After reading MSE.com I referred the matter to Bott & Co who handled the matter expertly and in a thoroughly professional manner keeping each claimant regularly informed on progress. Thomsons could not fob them off and I am delighted to report that on 5 November 2015 the 9 members of our party each received £365 compensation (after deduction of fees). Grateful thanks to MSE for advice and templates and Bott & Co for a great job.0 -

Well done, a great result.
Just out of interest, did the airline inform you of what the extraordinary circumstances were?
Tyzap. Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Tyzap: Thomsons advised the extraordinary circumstances were: “The aircraft you were due to depart on had passed all its pre-flight checks in accordance with the Civil Aviation Authority. It was after the aircraft had pushed back from stand that a technical fault was detected (engine start issues). This required a new starter unit which had to be transported from Manchester (to Glasgow). Unfortunately the crew then became out of hours and the plane departure was re-routed from Manchester.”0

Quick update on my saga.
Received a copy of the directions questionnaire from Thomson. They requested a change of court to Luton as they plan to call two witnesses, or that they may appear by telephone. I have written to the court requesting Liverpool due to the volume of cases of this type heard at that court.
Do I have anything to fear? What could their witnesses possibly say other than there was nothing wrong with the plane we eventually flew back on, but there was an oil pressure issue 3 flights previously, followed by crew out of hours when the delayed flight from Manchester eventually landed in Orlando to take us back? Are they trying it on again, which is my suspicion or have I missed something?
Thanks.0 -
Yes, Doris, they are trying it on. They try to get all the cases transferred to Luton for their own convenience. Whether they'll succeed depends on where you live. In your DQ you nominate your choice of court and that usually prevails.
It's highly unlikely that this case will ever get to trial. Thomson are fire fighting in that (a) They ar4e trying to clear the huge backlog of existing cases and (b) trying to deal with new ones. They do what they have to do with the Court to avoid getting a default judgment against them with a view to dealing with the case properly at a later date.
I don't defend this practice but I can understand it. All you have to do is press on0 -
Cheers again LM.

This is the first tie ever, anywhere, that I have posted anything so this is not a reply as such...just a general comment. I have a flight delay compensation issue with Thomson. Just to say thank you to so many of the contributors above. I'm think I know what to do given all this help. Thanks everyone.0

I have been trying to get a response and start the claim or at least Thomson to acknowledge the claim.
I have used the link via this site and also via the Thomson main site.
we travelled to Mauritius in Feb 2015 for our honeymoon, which was delayed by 3 hours departing from london and a further 24 hours on the way home.
(Some may think this was a good thing but my wife missed the funeral of her grandmother due to the delay.)
Departing london.
we were only told after we had checked in that we were delayed for 3 hours+
Departing Mauritius:
told by hotel staff.
no rep showed to talk to anyone untill next day which was to late to arranged alternate flights home for those in need.
I hade to pay a very large phone bill as I had to contact those who to collect us, caring for our daughter and to inform the family the funeral they had moved for us would be missed.
I have had plenty of automatic replies from them and a few stating they are working on it but it has now got to 64+ days and they have already stated claim should take no longer then 56 days.
I feel they are trying to lead me in circles I have tweeted them several times and been told numerous different things.
Would I be right to start thinking about small claims court.0 -
Hi
Would be interested to hear any update you have from Thomsons as we were also on this flight. The reason we were given at the airport was that the inbound flight had to make an emergency landing as someone had taken ill on board. As a result the plane was heavier than it should have been on landing and therefore had to go through checks before it could depart.
Having been in touch with Thomsons to try and claim compensation they have hidden behind the extra ordinary circumstances claiming that the delay was a reactionary delay due to unforeseen technical issues with the engine of the original aircraft due to operate our flight.
In a second letter from Thomsons they claimed the delay was due to a complete engine change after combustion damage was found.
Given recent court rulings we will be pursuing the case again. Did you also get the same update from Thomson re. the reason for the delay?

I have waited since November 2012 for a reply to my claim and they have come back with a totally different reason for the delay to the one we were told.. Many thanks.0
