We were told 16 hours before our flight that in reaction to previous delays within the fleet because of Hurricane Patricia, our flight was delayed.
It was delayed for 15 hours!
We booked a package holiday with Thomsons to Tenerife for last month. When we booked earlier in the year we paid for saved seats at the front of the aircraft on both flights. In August we received a call telling us that Thomsons had changed the aircraft to their new Dreamliner for the outward journey (only). As these are usually used for long haul flights (Tenerife is short haul at 4.5 hours), they asked if we would like to pay an additional £66 on top of our £60 already saved seats, to sit in Premium/extra legroom seats, again in the first row of the aircraft? We did.
The fact that they chose to use a long haul aircraft for a short haul flight, resulted in a 15 hour delay for our journey because it was stuck in Mexico,which had nothing to do whatsoever with our flight plan.
Would we be entitled to compensation for this or would they claim its under the Weather conditions/act of God policy note?0 -

Hi. they tried to pull this trick with me. they do it in the hope it'll put you off. You can send a cheque for 10 pounds to Thomson requesting all information held by them regarding you. this is called a Subject Access Request. I battled them for over a year and even had a hearing date for Court. I'd had to write a lot of letters and wade through a lot of legal stuff I didn't understand but it was worth it. they finally paid me £1000. A lot of the issues which Thomson were using to refuse claims have now been resolved so I think it should be easier to get your money now. Good luck!0

Can I ask you guys if the flights were on a Thomson plane? I was delayed on a flight from Faro to Aberdeen which I had booked with Thomson Airlines but when I complained they told me the flight was provided by Europe Airpost and to take the complaint to them. I have had no response from them and they have a disclaimer on their site saying they will only provide compensation if the flight was booked directly with them otherwise it is the responsibility of the travel agent to pursue. I'm very confused.0 -
looploop - have replied to your duplicate post. Your flight was with Europe Airpost so pursue them - the disclaimer is a nonsense but as I said copy/join Thomson in on your claim.0

Hi experts, I'm about to issue an MCOL to Thomson for our families flight delay compensation (which they have rejected). I've read Vaubans guide. The MCOL asks if I wish to claim interest and from when. What do people put here?0

8% from date of delay. Read guidance form for MCOL as all explained there. Be aware that a 'family' claim may require a N1 rather than MCOL.0

Thanks 111KAB. I'll work out the figure. I did wonder about MCOL over N1 but noticed in Vaubins guide he used MCOL but sited that he was claiming on behalf of his family in his text so I thought it would be OK?0
