  • I know I could go down the court route myself but I just don't have the time or patience for the sake of a few hundred pounds,what I need to know is should I continue with resolver as Thomson will respond eventually or shall I pass it over to the NWNF firms?

    If you can't be bothered to spend time in pursuing your own claim, then best advice is to forget it. Second best is to put in in the hands of a firm like Bott and Co and pay them for their services

    I naively, probably, expected Thomson to cave in once they had notice of the N1 I had filed for our 24 hour delay last year.

    I have had notification from the Court now that they intend to defend the full amount of the claim. As far as I am aware, they have no reason to do so, knock on effect, operational decision and crew out of hours as well (see my previous posts), but of course you cannot help wondering if somehow you have got it all wrong and missed something?

    Can anyone advise me as to what I can expect going forward?

    Should I request a copy of the Boeing report (which they won't have for an oil pressure issue) on what they may claim is a manufacturing defect and therefore extraordinary circumstances?

    Hi, I thought the same as you - I work for a London solicitors and as well as properly drafted letters, on the advice of colleagues I even sent my draft Particulars to Thomsons saying if you don't settle, I will issue on these grounds - nothing from Thomsons.


    So I issued my claim (again, properly drafted having been checked by lawyers and our court clerk!), Thomsons acknowledged (very late on) and said they intended to defend the whole claim, then lo and behold, around 10 days later, they called me to settle.


    So tho I don't really know full details of your claim, don't expect them to cave in as soon as you have issued your claim - they may well acknowledge and say they will defend before contacting you.


    I've posted here before about it, but in case you haven't seen it, we were first delayed for birdstrike damage, first noticed by the captain on his final walk round before take off (we were on the plane), second delay was "technical fault" to the replacement plane being flown down from Manchester - Thomsons never told me what this fault was, despite me asking, third delay was crew out of hours ... Thomson went with the birdstrike being the reason for the delay - which I argued due to it happening on a previous rotation (which they had admitted) plus the Ash v Thomas Cook claim.

    Hi, sadly my experience was that Thomsons only responded to the Claim Form being issued - I had a perfectly good claim, as I've said above (and numerous times - sorry for repeating myself!) I work for a law firm so had my correspondence checked over and so Thomsons should have known that I had a legal background, and/or was taking legal advice, yet they still ignored me until I issued a claim - this was despite me sending them my correctly pleaded draft Particulars telling them I intended to issue.


    I'm not familiar with Resolver, but I would say if you think you have a strong claim, but don't want to issue, then maybe go with a NWNF firm such as Botts - though if you do issue yourself and win/Thomsons settle, you should be able to get your costs back. Thomsons wouldn't pay interest and disputed my exchange rate, but the amount they paid was around the amount I'd claimed in compensation plus my Court Fee.




    Can I add - I don't work for Bott & Co !!! Couple of other posts I've said if you don't want to issue yourself, use a company like them, which is just because they seem to specialise in this sort of thing - unlike the law firm I work for !!!!

    It's beginning to look like Thomson are doing this as a matter of course.

    If an airline, such as Thomson, refuses to engage in the claims process they should be reported to the CAA.

    The CAA will look into your complaint, and the more that get reported to them the better. Give the CAA evidence and they will look into it for you, and eventually, take action.

    I know it's a bit of a pain, but it's a productive approach to persuading Thomson to accept claims and take them seriously rather than fobbing claimants off. Link to CAA supplied here....

  • I previously posted in August regarding being fobbed off by Thomsons re our flight delay. This has been going on since Nov 2012, with either getting no response whatsoever or as in August this year eventually answering after two years and saying they could not proceed with the claim unless we could find the booking confirmation. I did eventually get a copy of this and sent that back to them in August. It has been nine weeks and not a word, an acknowledgement ......nothing!!!, it seems pointless writing back to them as they seem to continuously ignore folk, as I see on these pages, so what next? Any ideas?
    Did anyone have any success emailing them and if so anyone got an email address.

    On 25.4.14 we were delayed over 6 hours going to Florida and then 22 hours returning on the 9.5.14.

    Thomson rejected my claims for compensation, then ignored my written replies and NBAs, so eventually I tried phoning. After a long wait the phone was answered, then I was cut off, so I vented on Twitter. This actually resulted in a reply from the claims department and a cheque for the return delay.:)

    There was no mention of the outward flight so I telephoned again, then about twenty minutes later received an email categorically stating we were not entitled to compensation.

    I decided to use Bott & Co. and about three months later we received compensation for the outward flight. :T

    Thank you to everyone who posts advice on here, and I know it's been said before, but if you believe you have a valid case don't give up!

    Thanks for that - I will do that - but can't Thomsons just say that they were too busy or come up with some other excuse - I know that some claims were paid out during the period Thomsons were ignoring me !!!!


    I wondered if they did have a policy of ignoring compensation claims until an actual claim was issued but because of the fact that I know from here, some claims were settled before issue that didn't seem to be the case.
