    Your argument re interest rates is that you shouldn't be out of pocket because of the airline's unreasonable refusal to pay your claim. But I am not aware of any law that would support your claim in this particular respect, unfortunately.
  • Vauban is right. The exchange rate payable is the rate as it is today. Also, you are only entitled to interest if you have actually issued court proceedings. If, having received a proper offer of settlement, the only reason for your issuing Court proceedings is to recover interest and argue about the exchange rate you will almost certainly lose and may well have to pay Thomson's costs
  • had e.mail about my delayed flt 2012 from botts, thomsons said my flt only 10mins late.If got no further proof closing my case.Not very happy flt not on flightstats .when started case told them we got on plane sat hour taken off then given food voucher to spend so defo not 10mins :mad:

    Thanks to all the support on here and to Vauban's excellent guide I have just received a cheque from Thomson for my claim. I had to go down the court route and had a hearing date set but they have now settled my claim. Our delay was in June 2009 so brought it at the last minute but am now very happy. Nothing else worked for me, there was no response to letters and I also used Resolver to no avail. If you have the case then just issue the court proceedings it is the only way they will listen.

    Well done - great result. I think you are absolutely right - by all means try writing a letter or using Revolver. But some airlines are still impervious to reason - until you issue a legal claim and then, surprise surprise, they realise that perhaps you had a point all along ...

    I had a Notice of Transfer of Proceedings to my local courts as Thomsons wanted Luton but the court gave my local one, this was over a week ago, and now also the 28 days to file any sort of meaningful defence has expired, what's the next move. Should I file for Judgement.?

    Yes but you will probably find that Thomson have got their defence to the Court in time and it's somewhere in the Court system

    I am not a regular flyer, so this is all abit new to us.

    We had a return Flight with Thomson, from Palma Majorca to Bristol UK , we were all sat on the plane, and pilot announced after a 45min to 1hr delay , that he now didn't have enough flying hours left to get to Bristol, basically he said that he had now ran out of flying hours, and needed to rest before flying again which would be the next day.

    Resulting in a 19hr delay.

    I have never heard of this reason for a delay before, is it common ?


    I take it I can claim for this delay ?


    I have sent a Resolver email to Thomson 6 days ago, but no response as yet, only a automated " thank you for your email"

    Am I going down the correct route with the claim ? or shall I write a letter also to Thomson using recorded delivery ?
