    19th Jan I got the bog standard letter saying investigating will respond in 28 Days heard nothing since.

    Well you could both send out NBA letters to put a fire under their butts. If you gave them a date by which you expected a response, then you are well within your rights to follow that up with a NBA letter. Send it recorded delivery.

    I called their customer services after I'd not heard a word, not even a letter to acknowledge my 1st or NBA letters and was informed that my case was with the investigators, and I was on day xx of 56.

    Still after waiting over 56 days I called them again and the Agent very kindly read me a letter that they would be posting soon together with my cheque.

    So follow up your letters, call them, if you still don't get anywhere start proceedings, but you need to show them you mean business.

    *Disclaimer* I was to lazy too issue proceedings, so I opted for the calling approach.

    Myself and my fiance was delayed for 24 hours around 4 years ago to Punta Cana, the reason letter at the airport stated because of the technical difficulties with the plane on a previous rotation.

    After numerous letters over the last few years and also waiting court judgments etc and then re-sending a final letter as well as pointless communications with the CAA, I've received a 4th letter back from Thomsons stating that due the delay was now due to a fuel shortage... which is the first time ive heard this despite having numerous letters from them in the past, others including 2 year rule, technical issues etc as reasons for dismissing the claim

    Is Fuel shortages an extraordinary circumstance and as the initial letter mentioned a plane on a previous rotation is this something thats worth pursuing myself as there is lots of interest to be had as well as the claim. Or should i just try a no win no fee who will take the interest and 30% approx if they win...

    Any pointers or help will be appreciated especially anyone who has had experience with this type of delay / fuel shortage / previous rotation.

    Q how many other flights were disrupted due to fuel shortages on the same day?

    If you haven't already read Vaubans guide and then issue a NBA, fuel shortages are not an EC unless the whole world run out of fuel that day, I think I've heard it all now!!

    Thanks, yes I have read his guide and was starting the MCOL route, but then i got the letter just before starting proceedings and couldnt find anything anywhere relating to fuel shortages so didnt want to continue unless i can get confirmation or at least some more information on it... Things is was it a shortage in our location or somewhere else, where does it say fuel shortages are not a EC...

    In the letter they state the fuel shortage then they recite a line as an example that would constitute an EC and its nothing to do with fuel its to do with a hidden defect, which puzzled me as a hidden defect is nothing whatsoever to do with fuel shortage, only thing i can think of is either a diversion or a cut and paste error.

    Can anyone confirm a fuel shortage is not a Extraordinary Circumstance.... there was no civil war going on otherwise we wouldnt have traveled... due to FCO etc.

    Any more pointers would be gratefully received.

  • Ok, thanks for the responses, anyone else had a similar letter or had to face a the same or similar scenario... just deciding whether or not to MCOL this.... what is the full MCOL costs and what is the potential loss if a claim doesnt get awarded?
  • If you're undecided on the merits of your case you can always contact Bott and go down the NWNF route, won't cost you a penny, just any interest and around 25% of any compensation, I'm sure other reputable NWNF Sols exist but I'm not aware of any.
