Flight delay and cancellation compensation, Tui/Thomson ONLY

Dear all
I posted on the main forum but just to let you know that I was due to go to court last Thursday and Thomson agreed to settle out of court for a delay from 2010. Thomson agreed 400 euros each (2 of us) and court costs. My ex-husband is a barrister and he did the claim for me and I am happy to email anyone a copy (it quite lengthy).
This was despite Thomson saying it was 'extraordinary' circumstances (it wasn't) and lying over the distance from Manchester to Palma (to try and get the lower amount). My case was put on hold in 2010 but I didn't give up!

Hi
Well done on your sucess Droylie.
I'm hoping I won't end up with a court case but I would be very grateful if you could send me a copy of your claim for guidance.
Many thanks0 -
I have been trying to obtain compensation from Thomson for a flight delay in September 2012 from LGW to Skiathos. I lost a day of my short holiday when the plane was denied permission to land on Skiathos due to, what they informed us, was faulty brakes. After being herded around the airport for hours and not given much info we were put up for the night in Athens.
After ignoring my various communications to them for 3 months, they finally sent me a form to complete in December. It's now nearly 5 months since my holiday and still I have heard nothing.
In view of the recent court case, I am wondering whether it is worth issuing a claim in the small court. It is just their complete lack of customer service that has really added insult to injury.0 -
Im after some advice please. My husband and I booked through Thomson to go to Mexico for our holidays we booked in April to fly out from Gatwick 30th May 2009 to Cancun, only doing so as the holiday was very reasonably priced due to the previous swine flu epidemic. On the 25th May 2009 - five days before we were due to go on our holiday, my husband got home to find an answer phone message to say that they were really sorry but they had to cancel our flight as they couldn't fill it and could someone ring them back asap . I rang the following day and was told once again that they had to cancel due to not being able to fill the seats due to the swine flu epidemic - people were too scared to fly and would i like my money back or to be placed on a later flight if they could find us one.. I had a phone call in the afternoon on the 26th May to say that they had some seats on the flight going out of Bristol two days later on the 1st June 2009. We asked at the time for compensation due to having paid for a hotel the night before our flight and parking at Gatwick and also having to take extra time off work and loss of wages and we were sent a cheque for £60 - for the two of us in way of compensation. I have seen that most people on here are claiming for delayed flights do you think i have a valid claim due to our flight being cancelled five days before we were going? Any help would be greatly appreciated thank you xxVery proud to be Strip club member No 430

Use my template in the FAQs to base your own letter to the airline and if they do not respond within the time limit you set or give you the run around regarding the reason for the cancellation, issue a legal claim straightaway.
Thank you so much for getting back to me so quickly - only just found out about this over the last fews days and have been umming and arring whether we had a claim or not. You make me feel so much more confident now about doing something about it :beer::beer:Very proud to be Strip club member No 430 -

In October I then wrote referring to the EU legislation and they have now sent me a claim form after me chasing them. They want our boarding passes. And unless we send them the form will be returned. Not many people keep their boarding passes so fe,el it is an avoiding tactic by them. Anyone else making a claim for this flight TOM 30 gatwick to montego bay? Percyandbob
My husband and I were also on that flight to Jamaica on 26th June 2012 and remember well the delay to our flight.
I managed to find both our boarding passes, these still inside both our passports and after taking a copies of these, sent all by recorded delivery. Within 3 days I had a response, a standard letter confirming reciept of my letter.
Since reading your post, I have just this minute spoken to Thomson, who confirmed they have recieved the letter and boarding passes and will be sending out a claim form.
I guess I can only wait and see, but will keep you updated.0 -

Is this the correct address and is straightforward first class post the best method.
Yes I used this address and sent mine by recorded signed for.
I was able to verify reciept by using Royal mail track and Trace, however did not need to do this as Thomson responded within a couple of days.0 -
I'll make this brief. I was delayed on a return from Lanzarote in 2009, we got to departure and they cancelled the flight. Collected luggage and put up in a hotel. I can track the cancelled flight but unsure as to flight number that we were sent home on the next morning. Any ideas how i can find out?0

Thanks, didn't realise there were a number of options on Flight Status. So I was over 20 hours late. Is there anyway I can find the reason for cancellation? I seem to remember there was something wrong with the plane in the UK and then flight hours for the pilots.0

OK thanks
I'll tell them what I think and ask them to confirm.
