Yes - you are right. The weather didn't affect your flight: this is an operational problem.

    Thank you, appreciate your reply.

Along with many others I'm waiting for a response from the Court to my request that the stay is lifted. Unless Thomson pay in full then I will be continuing the action

I found that e-mailing thomson direct as well as the court gave a much quicker response as it took six days and I had my offer on thursday this week by e-mail so i am really pleased with the speed of my offer finally ,still waiting to hear from the court
  • @markylou I was also on the CAN - MAN flight scheduled on the 28th July. We know that the MAN flight was switched with the Gatwick one (Proof of this is on flightstats.com which clearly proves ours returned to Gatwick)
After complaining to Thomson who didn't get back to me well after 56 days the reply I got from Neil Sexton was the usual crap you would expect saying the delayed
" TOM175 was due to a previous scheduled flight being diverted due to thunderstorms at the airport of arrival. This caused a knock delay to your flight" haha! rubbish!! We all know the MAN one landed and the Gatwick one was delayed. The one they kindly swapped and gave to the MAN customers! Plus the crew were late as they were out if hours etc (because they were on the flight previously disrupted by the weather). Funny this all happened when all the baggage probs were happening at LGW too.
Would urge all on the flight to seek comp as they are lying. My case is currently with the CAA but if that doesn't hold up I'll go to court

*sigh* The CAA are not your friend. They tend to support the airlines over the passengers. And if they do so in your case, their support will be cited by the airline in any court action you take. DO NOT INVOLVE THE CAA - THEY ARE NOT ON YOUR SIDE!!!
  • Hi all. First time poster so be gentle.

I sent a compensation claim for a (total) 6 hour delay from exeter to Dalaman. Can someone confirm that the 400euro per passenger is the correct amount to claim as I did in the original claim 3 months ago?

Additionally, the customer service was disgraceful so thomson have agreed 50pp voucher for that!

You can find the answer to this question in my guide. Go on - have a read.
  • Thanks Vauban, I'm not sure I found the correct feed though; I linked to the MSE general flight delay claims page, from which I made my original claim with the info provided there. It's just I've noticed conflicting info from different sources.

    Regards. T
  • hi all of this info is great but can anyone help me to try and find my holiday flight info. as its 4yrs ago and i have no paper work. i have looked on flight stats and cannot see my flight numbers? Where do i start. Also the issue with the boarding passes has anyone been lucky re getting any info and has anyone won any cash from Thomsons? Cheers:j
  • Hi All.

What's everyone's thoughts on the interest rate on claims? Thomson's seem to be offering 3% when trying to settle cases now, however, if MCOL suggest 8%, why are they citing this as being an unreasonable amount? I don't want to seem greedy, but after a near on 2 year court battle, and them trying to worm their way out of every penny possible, I feel like I just want what's owing.

Also, I paid a solicitor fee to someone from this site about a year ago, which they've said they won't cover in my costs. I don't mind if this is the case, but just want to check that's correct?

    Thanks for any advice!!

8% is the default: judges don't always give it, but it's entirely legitimate to claim for it.

Generally, costs of legal representation are not recoverable on the small claims track. But I'd be surprised if there were any solicitors accepting instruction on this site: who did you engage?
