Yes you certainly do have a claim depending on the reason for the delay.0

I signed up to Bott and Co in the late Summer after Thomson didn't even sign for two "signed for" letters I sent them.
Bott told me this week that court proceedings are unstayed and Thomson have 14 days to respond, I guess we will soon see Thomson's response.
We are 5 passengers, longhaul and highest tier of delay so I guess a pretty juicy one for Bott.
I know I'll lose a fair bit of the payout but I simply couldn't be bothered with the stress and time that some of you are putting in to it. Bott seem to be on top of things and I can get on with my life!
I'll post any updates.

Thomson stated that airplane was playing up previous few days and delayed coming from Manchester to larnaca, therefore the knock on effect.problem I'm having is thomson yet to espond to emails or mail. What's best to do ?0 -
I've written to the Court asking for the stay to be lifted and suggested to Thomson they should now settle. I have asked for my claim in full €600 per passenger (4) court costs to date and interest at 8% (that's over £500 so far).It will be interesting to see their response especially as the CAA had actually agreed compensation was payable but Thomson refused to accept the ruling. What are the thoughts re interest and if Thomson offer the compensation plus court costs only? My view is that interest should also be paid but is the 8% too much?0

flight from larnaca was delayed 23 hrs 35 mins by thomson, even though we were put up overnight would we still be due compensation ? used thomson online form 4 times and written letter and still no response, only automated mail stating reply within 28 days, but first one sent 20th sept, anyone else have this problem, thanks
I haven't had a favourable response yet, just two rejection letters quoting "extraordinary circumstances", when in my case it seems like an operational issue as the flight that had issues was 3 before mine, thereby creating a knock on effect. In answer to your question, I have a much better response, albeit a negative one as yet, by e mailing David Burling (chairman or ceo of thomson I believe) directly at david.burling@thomson.co.uk
and cc in the e mail directors@tui-uk.co.uk
Unlikely he will read it, more one of his office staff, but I have always had faster answers that way.0 -

With a huge backlog of cases, it's in Thomson's interests to get them sorted out as soon as possible. The last thing they'll want is to have to send someone to court to argue about interest.0 -
I want to say a massive thank you to everyone who has helped me on this long road,I have just accepted an offer from Thomson based on 5% interest after a little negotiation with Thomson. It has taken me two long years and lots of help on here and without you all I would never have got this far will still keep popping on here from time to time just to see how you are all getting on

Nice one heres to more success stories on here.:beer:0 -
Thanks for your thoughts. I have my suspicions that Thomson and other airlines will try to avoid paying the full compensation due by various means despite the cases. I hope I'm wrong but experience to date (with a couple of notable exceptions) seems to suggest they will try to wriggle out or put barriers up to deter claims. The next few weeks will determine how this pans out and hopefully finally result in payment for the full amount claimed with no quibbles. One can dream0
