    I want to say a massive thank you to everyone who has helped me on this long road,I have just accepted an offer from Thomson based on 5% interest after a little negotiation with Thomson.It has taken me two long years and lots of help on here and without you all I would never have got this far will still keep popping on here from time to time just to see how you are all getting on

    You don't need to dream. Or pray. Or anything except take legal action. As the airline no longer has a defence for normal technical failures, you'll have them over a barrel. But you have to be prepared to take the final step, if the airline still refuses.

    Along with many others I'm waiting for a response from the Court to my request that the stay is lifted. Unless Thomson pay in full then I will be continuing the action

    I cant believe they would act so.
    I am convinced that now, in the light of refusal of leave to appeal, all airlines will automaticlly contact delayed passengers and send due compensation as a matter of course,. It wont even be necesaary to claim. The CAA will oversee this. NURSE!!!!
  • Hello all, Newley registered but not new to the site.
    Firstly many thanks for all the posts , as If it was not for this site I would not be aware of compensation owed to me.

    So on to my situation.
    I am claiming for 2 people for a 7 hour delay on a Thomson flight from Geneva to Gatwick on the 14th feb 2009.
    I sent the template letter with a claim for 500euros and received back after 6-7 weeks the standard reply stating that because it was over Two years I cannot claim and to contact them pending the outcome of the Supreme Court judgment.
    Today ,having seen the outcome, I tried calling them and stayed in there queue for a record breaking 95 minutes before I had to give up.

    What I hoping for some advise on is what next move should I take ?
    Should I email them again in an attempt to claim compensation again met inking the outcome of the decision.
    Or , should I email/write a "Notice of action" (sorry if incorrect).
    Giving them 14 days to respond or I will start court proceedings ?

    I certainly do not want to give up but I'm worried as the 6 year time frame is approaching.

    95 minutes on the phone? Wow!

    You have time to claim. Don't bother with phone or email. As you have already sent the template letter then send an NBA ensuring you include details of the Court of Appeal ruling and the Supreme Court's decision to refuse appeal. After 14 days start a court claim. The 6 year clock will stop ticking only after a court claim has been submitted.

    Agreed. You are one of thousands of cases in the pipeline to be cleared. If you do issue proceedings remember you can claim the amount in Euros or sterling equivalent and remember to claim interest at 8% p.a. from the date of your flight until the issue date and thereafter at the same rate. You may not get 8% but that's the current rate on judgments and if you don't ask you won't get!

  • Please could anyone advise me whether you think I would be entitled to compensation based on the following?

    I was due to fly from Doncaster to Faro on 26th July 2012 at 8.30am but the flight was delayed by ten hours and we finally departed at 6.30pm. The reason for the delay was that our plane had previously flown to one of the Greek Islands (Rhodes I believe) but couldn't land there due to dense fog so had to divert to another Greek island (kos). Due to the diversion, the crew that were on the flight to Greece were then over their allocated flying hours and couldn't complete the return flight. This meant that the plane we should have flown to Faro on was still in Greece. Thomson then had to find an alternative plane which came from Birmingham airport and we departed at 6.30pm.

    I appreciate that the weather played a part in the delay but it was on the previous flight and it took them ten hours to bring in another plane. Any thoughts would be appreciated. Thank you.

    Yes - you are right. The weather didn't affect your flight: this is an operational problem.
