Good luck to all those who manage to gain compensation for flight delays.
My wife and I were delayed in Manchester airport overnight in July 2010, due to fly to Corfu with Thomson. We have no documentation after 4 years and despite trying to nail down the actual flight, we have made no progress - anyone any ideas?0 -

I emailed Thomson requesting that they settle my claim which resulted from a 12 hr delay in January 2011. They have replied offering to settle at 600 euros each but say that the exchange rate used is that at the date of settlement i.e todays rate rather than the rate at the time of the delay. I used the rate at the time of the delay which was 1.2 euros as opposed to the 1.28 today a difference of £60 ... Who is correct me or them ?

From Bott & Co twitter today "exchange rate is BoE rates the day we first write to the airline or on issuing proceedings. Airlines may argue this point."0

Not entirely correct I'm afraid. See CPR PD 12 5.2.

" Where default judgment is given on a claim for a sum of money expressed in a foreign currency, the judgment should be for the amount of the foreign currency with the addition of ‘or the Sterling equivalent at the time of payment’.
Of course this applies to a default judgment but I see no reason why this would not apply to judgment after a trial.

Although simple logic should dictate that the rate would be what was in effect at the time of the delay, since in an ideal world we wouldn't have this constant and determined, some may say vexatious, delay and procrastination by the airlines.
Next time I am delayed by an airline, i expect the compensation to be paid within a couple of weeks. Indeed, I would expect payment as I step off the delayed plane...
