    I think we will find a lot more of this happening. I am aware of one case where Les Oiseaux have requested a further stay but so far not granted

    'Les Oiseaux' have written to the courts, requesting that ALL Jet2 cases be stayed pending the Amsterdam case. I've seen the letter posted on here.

    Let's hope all the Judges, up and down the County take one common view and the cases are finally heard.

    Hi all,

    My case is going to court on the 11th December, I've gone with EUdelay as i had no luck on my own, its taken about 2+ years to get this far!

    Is this new ruling they have been telling me about a good thing in general then for us claiming our money back?
    Halifax loan - 6800 - 198 DD a month
    Barclay card 0% - £2000 - £150 DD a month

    It's not really a new ruling, just clarification from the Supreme Court, that you CAN claim for airline delays going back 6 years, not 2 as Thomson were saying.

    Good luck with your case, it might even be settled before you walk into the Court room

    I'm intrigued by the whole thing in court, so I kinda want to see it all played out but would just accept payment before court of course haha

    If you can afford the time (research/patience) and expenditure (application and fees) the court experience is well worth it and the personal rewards almost as great, if not greater, as the financial ones.

    I agree but after possible years of research, court bundle in hand, after practicing your speech and how your going to deliver it - 5 mins before you walk into Court Thomson offer to settle with 8% interest - still a great victory - but somewhat disappointing that you didn't have your say and get to watch the Judge look down through moon shaped glasses procrastinating at Thomsons solicitors as he/she hands down judgement in your favour.

  • Agreed, but do remember that you can ask the Judge to award greater costs than are normally allowed in small claims cases on the basis of unreasonable conduct, and this will also to apply to LIP's. See CPR 27.14(g). This can include fighting the case all the way through and giving in at the last minute. Strangely enough it doesn't include fighting the case on the day and losing unless the Judge feels that they never had a case at all and things such as breaches of previous orders.
  • So, after nearly 2 years since commencing procedings on my claim, I've just written to Thomson asking for settlement on my stayed case and another letter the court asking for the stay to be lifted following the failed appeal against DAWSON.

    I'll let you know the response!!
