  • I am starting this thread for those claiming flight delay or cancellation compensation from Thomson.

    Any posts regarding any other airline in this thread will be ignored (at least by me).

    Pleased to find your thread, particularly after watching the Martin Lewis show on ITV last night . We wondered whether we could claim a refund ( anything), from Thomson , we travelled as a party of 4 adults, after enduring a 24 hour 10 mins delay on what was scheduled to be flight TOM 048 departing Gatwick 5th Jan 2011 to the Dominican republic, we recieved meal vouchers & an overnight hotel at the airport, but upon return & trying to claim anything from Thomdson were rebuffed at every turn, do you believe we have a valid case to pursue? Please note we still have copies of the Thomson delay letters.

    We also suffered a delay of over 6 hours on a long haul flight at Manchester Jan. 2011, received no help etc whist at the airport.
    Since the October judgement we have written to Tomsons 6 times and received no response what so ever.
    We have joined Which and receive legal asssistance from them.
    They advised us to start a claim in The Small Claims Court which is in progress at the moment.
    They have decided to defend our claim and sent a defence which completely ignored our claim under 261/2004. Their defence was based on The Montreal Convention totally ignoring our 261/2004 claim.
    We have returned the Allocation form with our comments and await the next step.

    Today submitted a claim using the MSE template as we feel it is Thomson who should be paying compensation. Will post when/if we receive a reply.
  • 2 days after paying balance on holiday, thomson have cancelled our original flight and given us another one to depart 6 hours later, with a different airline and not with our pre-booked seats. Our original flight was to depart 6.30am so that we would arrive at our destination just after lunch therefore enabling us to enjoy the rest of the day - now we will arrive early evening and have paid for a wasted day. We always fly early hours so that we don't waste the first day travelling.
    Can we claim anything as they have cut short our holiday by delaying our outward flight by 6 hours, yet we still return home on our original flight time.
    Can anyone advise if i have a claim ?

    As long as you have been informed more than 14 days before the flight, no

    That is as regards the airline, the travel agent may be a different matter (they do operate as separate companies) check T&Cs

    We were on a thomson flight from barbados to manchester in january 2009. the plane was on the runway being led out prior to departure when the plane rolled into grass. it could not be moved and all passengers and fuel and luggage had to be removed to get the plane out. by the time all of this had been done they had decided to cancel the flight until the next day and put us up in a hotel in barbados overnight and we returned the next day.
    would this qualify and what would you think the likelihood of success would be based on the circumstances plus the fact that it was over 2 years ago.
    it was part of a package holiday if that makes a difference. we made a claim on the insurance and got about £30 back if memory serves (just in case thats important too.)
    any advice gratefully received.

    when i send my initial letter, should i be sending a "delay" claim or a "cancelled" claim?
    on flightstats, the flight was cancelled, but in the letter from thomson after the incident back in 2009, the flight was delayed.
    it was an evening flight and by the time they had sorted the problem the flight crew had passed their allotted time without rest so we were sent to hotels and put on a plane the next day. but would this be a delay or a cancellation? i know they amount to the same thing really but there are different letters for the different situations so i dont want to make a mistake.

    Hope you get somewhere with this. I will also be contacting Thomson using the MSE template letter as I also believe it is Thomsons that should compensate for the issues we encountered.

    If you don't mind me asking, what have you claimed for? Would it be the 400 euro per person as previously mentioned as I understand that as the delay was over the maximum period and the flight length was also the middle tier?
