I can't believe people are still asking this 2 year limit question.

Is there a reason that the FAQ's and several threads on the subject aren't being accessed?

Think I'll give up. Good luck everyone.

I guess after the programme this is all new to people and so its easy to just pop on here and ask without realising some of it has been discussed for months by those already aware of the ruling.

It was just a shame that Martin didn't grill Thomson as those who claim after watching the programme will come up against the 2 year misinformation letter that Thomsons are routinely giving out.

So 14 days is up and nothing at all. Just wanted to explore both of the above options. MCOL charge £80 per claim and presumably you have to go to court and defend yourself? No win no fee take circa 25%, but do you still have to go to court and do anything (apart from watch Thomson squirm)?

Hi, if anyone was on FLIGHT TOM 670 from NEWCASTLE on SEPTEMBER 29TH 2011 this flight was to ORLANDO SANFORD AIRPORT could they please tell me if they can remember what reason we were told for the 7 hour delay and if they have had any luck with a claim. I have waited since November 2012 for a reply to my claim and they have come back with a totally different reason for the delay to the one we were told.. Many thanks.
  • We was delayed for 5 hours when we went on our Honeymoon to the Maldives 08/09/2010. I haven't kept any of the receipts or boarding passes. I have checked on flightstats and it is saying that actual departure times were unavailable. Is it worth me pursuing this?

No win no fee also (generally) ask you payment to cover Court application cost (sounds like £80 in your case) as they do not want to be out of pocket.

i dont know what i am thinking of doing yet, i am just gathering information as i dont want to be paying out any monies as that would defeat the claims.

It's difficult to get compensation from Thomson, those in the TV prog probably got their's from other airlines.

Hi, I am finding this quite confusing so would welcome some help & information please.

We booked a package holiday to Salou with first choice/thomson in June 2011. We were due to fly home at 8.20pm on 28th June 2011 (landing at 9.50pm) but flight was delayed due to a mechanical problem with the plane. We were returned to our hotel and provided with dinner then told Reus airport closes at 9pm so we had to be transferred to Barcelona airport to await a flight. We eventually landed at Newcastle around 5am on the 29th June 2011 so a delay of approx 7 hours.

    1. Can we make a claim?
    2. Is compensation per person including children?
    3. Is it the lead passenger who claims for all in the party?
    4. How do I find booking references.
  • I submitted my initial letter on 25 Feb 13 and as yet have failed to received even an acknowledgement of receipt from Thomson. I tried calling this morning, but the relevant section were absent, due to Good Friday (funnily enough, Sales were open!) I intend on calling them again tomorrow to chase up my case.

Our delay way Aug 2011, within the "2 year period" Thomsons argue, so I expect to receive an "exceptional circumstances" letter as per everyone else. We were delayed due to mechanical problems which I am more than aware are NOT EC. I will contest this and if nothing is forthcoming, I will issue an NBA Letter and look into beginning MCOL action after the requisite time period.

I will continue to monitor this thread and will be interested to hear how others further along the claim process get on.

yes if you were delayed for over 4 hours on this flight you should be able to claim 600 Euros per passenger, start by writing to TC stating name and flight details, and requesting compensation for the delay under ec261/2004. They will probably deny it at first, but that is the way to get the ball rolling.
