Hi sorry to jump in here but not sure where to post a new one?? We were delayed coming out of Dalaman on the 17th July for 6 hours, I have sent the template letter 3 weeks ago but have not heard anything, not sure what my next step should be now? any advise? thanks
Since they haven't replied to your letter which gives them 14 days to respond, your next step should be a Notice Before Action (NBA) letter giving them another 21 days. They seem to answer these ones pretty quickly judging by what other people on here have posted.
If your claim is rejected, don't bother with the CAA, they're useless as they just agree with the Airline's decision most of the time. If you don't want to take them to court yourself, hand it over to a NWNF company.
    Hope this helps, good luck!!
  • Thank you for this, Traceylou. Is there a template letter for an NBA on this site? anyone recommend a good NWNF company to use as there are so many out there!!!
  • Apologies if I've missed something here, but I've been reading all day and I'm pretty confused now!

I flew with Thompson in February. The incoming flight was delayed by the weather, which is quite common on this route, resulting in a 5.5 hour delay. The flight was to a ski town, so the weather can be bad.

Thompson made the delay a lot worse by deciding to reroute the flight, around 200 miles from the original airport. They then transferred us all to the original airport via bus, making the total arrival delay 10 hours.

On the plane, they tried to offer us food but hadn't managed to restock, so ran out after the first two rows. No water or drinks were offered, because of stock issues.

They ignored our letter asking for compensation, claiming extraordinary circumstances caused the initial delay.

Do I send a letter before action now?

The FAQ's seem to have disappeared again from this thread, but post No: 5367 has a link to them where you'll find NBA Template Letters.

You could check out Botts, I believe they specialise in Aviation claims and have had some degree of success.

Unfortunately the link to the NBA template letter is dead. Does anybody have a live link? I keep getting this error message:

I have used the money saving expert form to claim compensation for an 8 hour delay on our flight from Birmingham to Barbados in March. They have replied to me saying they do not pay compensation for flight delays.
I have proof that others on the same flight have received 500 euros per person in compensation.
    What should I do now?

    more information needed
What exactly do they say in their reply? are they saying it was extraordinary circumstances or something else?

The correct amount, if compensation applicable, would be €600

Hi caz3121. Our first reply from them said our delay due to a technical defect found just before take off which is classed as exceptional circumstances. However we rejected that excuse from them as we know that the delay had been caused earlier in the week and every flight there after was delayed.
We also found out from another forum that other passengers on the same flight have already been compensated.
We sent another letter explaining all this and today received a letter stating Thomson do not compensate for flight delays as the cost should be claimed back through our travel insurers.
They then thank me for my feed back and assure me they are not complacent!
I tried to phone them today but after waiting an hour on an 084 number I had to ring off.
Knowing that others have been paid compensation makes me even more angry to receive this reply from them today.
The other thing is the letter today is quoting a completely different booking reference, which makes me think they have made a mistake.

They have not made a mistake - they are playing a game - more likely than not (like the rest of the passengers on your flight) you are due to a compensation payment but the airlines have not set aside monies to settle these claims so now they are getting worried and putting obstacles in the way of (legitimate) claimants in the hope they give up.
