No surprise Thomson has asked Liverpool Court for a 2 month stay pending Jet2 might appeal to Supreme Court and then time for decison about whether an appeal will be permitted. I've objected on basis Huzar is now established case law but don't hold out much hope. The more this is delayed the already limited chances of me ever using TUI in any guise reduce further.

My personal boycott of TUI is now in its 3rd year. That's a family of 4 adults (kids now classed as adults) choosing alternatives. How many more potential customers are TUI losing due to their attitudes. Someone at TUI should do the maths!

Regarding Flight TOM773 returning from Sharm El Sheik on 13.06.14 (30 Hour Delay)

I have sent my complaint letter to Thomson by first class post this morning, hoping to receive a response within 14 days. Will keep the forum updated.

    Probably not many.

For me it's all about price. If TUI are the cheapest then I'll still use them.

Also, if they are delayed again then I'll take them to court again.

And think of all the extra people using TUI because Monarch/Jet2/Thomson/etc let them down, and they won't use them in future etc. The airlines are mostly all as bad as each other. It is an industry-wide problem.

So now I am surprised! After a year of back and forth I am on my second hearing date next week. The first was postponed due to lack of Thomson paperwork.......what a surprise. In between times we have Huzar and now Dawson results. Their defence is the usual claim being over two years old and a technical fault. I have also had the thumbs up from the CAA, unusual I know, stating that they believe in my case compensation should be paid as there are no grounds for extraordinary circumstances.
It now seems that they want to continue with the hearing based on delaying until a further appeal is heard on either Huzar or Dawson, if it happens, when it happens. So in essence we could keep going around in circles for years........or not as the case may be!
    Thoughts?

I agree they are all the same but I feel better for the boycott! It has actually been quite liberating to escape the clutches of the usual suspects of holiday companies and instead of a default option of a fly and flop holiday look at other alternatives. I've been using the likes of Easy Jet & Flybe without issue to explore cities and the likes of the Italian Lakes.

I thought maybe I was the only one who'd noticed the sad irony that the original claims are for unnecessary delay, but pail into insignificance as compared to the delays now being imposed by the legal systems. If I were in control of my own claim, I would be back at Court pronto, but Bott & Co. have mine, and through no fault of their own, are constrained by the legal process. A deliberate act by the likes of Thomson, in the hope that a good number will just abandon the process and move on with their lives. Is it worth the stress? I bet plenty will decide not!

I was on a scheduled flight to Gran Canaria on what I believe to be 2nd May 2009. It was delayed for what I remember 22 hours, we were put up in an on-site hotel for around 5 hours and I can remember that it was the morning that Ricky Hatton lost his boxing title to mani pacquani, or some name to that effect.

I have tried searching for this flight delay and cannot find it anywhere. We were due to fly out if Birmingham airport on the Saturday afternoon but did not fly until the Sunday afternoon. I am beginning to doubt myself that this happened, due to not being able to locate this delayed flight as it says it was on time, but I remember that it wasn't. Was anyone else on this forum in this flight, long shot I know, or can anyone give me any advice as to anywhere else I can find this info apart from Flightstats. Many thanks. Donna.

I was booked on this same flight in 2009, from what I can remember we was due to depart at 10.30pm but we did not depart until 2.30pm the following day. Yes the Ricky Hatton fight was on that same night.
The info we was given by Thomson was their was a technical error with our plane, then the replacement plane was damaged by a large vehicle and there was no other planes available to take us so they put us up in a local hotel. They took us back to the airport at 7am on the sunday morning but we had to wait for a flight coming in from Zante before there was an available plane to take us to Gran Canaria so by my reckoning we was delayed for 16 hours.
Like you said I have also found NO record of our flight on Flighstats.com and unfortunately I have erased the original email when I booked the flight.
If anyone else was on this flight and knows of the flight number this would be a great help.
    thanks
    Mark
