    You should add the following text to your particulars of claim

    The claimant claims interest under setion 69 County courts act 1984 at the rate of 8%a year( from the date when the compensastion was payable to the date ofissuing the claim)of £xxxand also interest at the same rate up to the date of judgement or earlier payment at a daily rate (daily rate of interest)


    To work out the daily rate use this calculation .00022 x amount of claim

    To work out the amount of interest you are owed up tothe claim date use this calculation
    Number of days passed x daily rate of interest

    You can then add this amount to to the amount you are claimimng
  • Just received a letter from Thomas Cook staying the following:

    I'm sorry that you remain unhappy with the way your complaint has been dealt with initially and further comments you have made will certainly be considered.
    Following a review of your entire case,you will be contacted again with a view to bring this matter to a satisfactory conclusion to all concerned .

    Fingers Crossed / Has anyone else had this letter and had there claim resolved !! Or is it another stalling tactic !!
    Well what a joke Thomas Cook are , Not only do they have a lot of technical issues with there planes but they now can't get it correct in there offices !!
    How ironic after calling 5 days ago about my claim and being told it was all in hand and being looked at and that i should receive a reply before the 28 day deadline ( Tues 26th March) I receive this in the post yesterday :
    My intention was to have responded to your further comments by now,however, due to technical fault with the system used to store all scanned images of our customers letters,some files have been damaged,unfortunately,yours was one effected so i write to ask if you are able to forward me a copy of your original letter.

    Please accept our sincere apologies for this inconvenience,i realize that this reflects on your opinion of Thomas Cook , However ,I hope you will appreciate that such problems occur with technology,i will be happy to address the issues you have once i have some further details.

    Surprised they didn't say an employee broke down in his car , Got to work late, pressed the wrong button and it was beyond there control... it was as they say EXTRAORDINARY CIRCUMSTANCES!!!!!!!! LOL ......NOT :T

    Probably caused by a system overload, 1 in 31 of their planes were delayed by more than 3 hours last summer, compared to 1 in 170 for Thompson, and 1 in 320 for easyjet. No wonder the company is bust:rotfl:

    You can serve corporate proceedings on any office of the defendant that has a close connection to your claim, so you needn't worry about whether or not you have the registered office.

    I have a few days remaining since i sent my NBA. Have waited 4 weeks for the CAA and no reply, feel they will reply with unable to help as my flight was out of the EU to Gatwick, from posts i have read.
    When completing the forms for court action online, should i be claiming for a specified amount or unspecified? I know i am owed 2 x 600 euros for the flights, not sure if i convert from todays exchange or date of flight on 22/10/07? Also claiming for overnight accommodation, of which i have no receipt so not sure how that will go. Interest, i have seen someone post how to calculate the daily rate but what date would interest be payable from? Flight in 2007 but claim only started this January?
    Any other costs or compensation i should add aside from court fee?

  • As I prepare for my MCOL I have found references on the Thomas Cook forum that the delays to my outward and return flight were due to 'problems with the fleet' as opposed to specific events with my flights. What is the position with regard to knock on effects on 'the fleet' as opposed to specific flights? any advice appreciated

    Quick update on mine.

    Recieved email from tc saying they think I am due compensation.

    HOWEVER they cannot trace my booking reference. It was booked via youtravel in 2008. But flight was with. Thomas cook. I sent them copy of my youtravel email confirmation

    Thomas Cook have a issued an acknowledgement of service via MCOL. Can someone explain what this means. I assume its another delay tactic.
