It only seemed reasonable to claim interest from the date I claimed compensation from TC, but there doesn't seem to be a definitive answer as mainly at judges discretion.
Indeed, this is an issue that frequently pops up on here, like you say there is no definitive answer, so you can use either the time of the flight, or the time you submit paperwork either is acceptable.
Use whichever is the more favourable.

Hi Cath, I had similar issues with filling in the claim form, but had to do paper N1 as more than one claimant. The judge is likely to state the interest that can be claimed but certainly include this on the form I worked out the exchange rate from euros on the date of the delayed flight given that under the legislation compensation is supposed to be paid immediately. It only seemed reasonable to claim interest from the date I claimed compensation from TC, but there doesn't seem to be a definitive answer as mainly at judges discretion.
So my claim was the £ equivalent of the euros plus the interest. Their is a separate box for the costs which will be the £70 court fee. Which added together gives you a grand total for the final box. Apologies if the Mcol form differs greatly from the N1 which I have completed...
I'm confused - should I be doing a paper claim then as it was two of us travelling?? Or have I misunderstood that?0 -
Officially MCOL is only supposed to be used when there is only 1 claimant. You only have to read through some of the previous pages to see examples where people have hot as far as court hearings only to have to start the whole process again. Whilst there are examples of success with more than one applicant through the MCOL route it's not something I want to give TC ammunition on.0

Difference of opinion - I did MCOL for 2 and 'won' for two but if you want 'belt & braces' go for N1.
Agree, Any reasonable DJ would agree to an oral application to have any additional claimaints added at the first directions appointment, unfortunately not all DJ's are reasonable.After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I am at day 33 of the 'You will recieve the compensation within 28 days...' I made a phone call to the number at the top of this page and was advised due to a high volume it may take slightly longer.
I will wait for another couple of days before making another phone call. My assumption is that I will receive some vouchers through the door which I will then need to return before another 28 days wait for cash.0 -

As long as it's within the Courts time frame as already set out, simply address the correspondence to the Court Manager, and ask to attach to the court bundle file.After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

Submission time has passed, perhaps I can submit to the court updated versions of documents the defence want to use at the hearing?

wonder if anyone can advise.Have had correspondence with Thos. Cook
over the last 3mths.Their replies have ranged from not able to trace our party,to which I replied, in that case return my money I paid for fares, to an e-mail I received yesterday,stating they had traced my flight and it was only
24mins late. This is absolute lies,12hrs in Palma becomes 24mins. I have a sneaky feeling they are quoting time for the flight that eventually brought us home.What would you advise as my next move? Before lodging a Notice before claim,should i ask them,under the Data Protection Act for all information regarding my homeward journey to Glasgow from Palma on the date in question.Any advice would be welcome.0
