  • Help. I was on a flight from pathos that was delayed, by at least 8hrs, some time after the 10th of sept 2009. It could have been the 11th, 12th, 13th, or 14th. My problem is I cant find the airline or the flight. It was my sons wedding and he got married on the 10th sept 2009. The holiday was booked with thomas cook. Please Help.
  • I have had a successful claim against Thomas Cook and awarded 250 Euros each for 4 = 1000 Euros which they converted to £780, which is fine, but we did not get cash but a voucher to use with Thomas Cook.
Can they do this i thought we would get cash back as no mention of credit voucher, which restricts us on choice.

Have a look at Vaubans guide, but you will have to find more details before you can even think about a claim.

    HI all,
I'm just filling in the claim form with Money Claim Online as the guide states. I've got to the point where it asks me how much, in pounds, I'm claiming for. How do I calculate it? Should I do it by today's exchange rate? And then the costs and interest - is that the £70 and the 8% of whatever the exchange rate ends up being?

Sorry, not done this before and not confident! TC won't allow me access to their reasons for delay (7 hours to Dalaman), and I have no paperwork, only the date we flew and our flight number. the flight also doesn't appear on the flight tracker. i've asked for details as to why it was delayed but they won't tell me, and I've also asked for confirmation as to the exact length of delay, but they won't tell me that either!

    Plodding on!
  • Hi Cath, I had similar issues with filling in the claim form, but had to do paper N1 as more than one claimant. The judge is likely to state the interest that can be claimed but certainly include this on the form I worked out the exchange rate from euros on the date of the delayed flight given that under the legislation compensation is supposed to be paid immediately. It only seemed reasonable to claim interest from the date I claimed compensation from TC, but there doesn't seem to be a definitive answer as mainly at judges discretion.

So my claim was the £ equivalent of the euros plus the interest. Their is a separate box for the costs which will be the £70 court fee. Which added together gives you a grand total for the final box. Apologies if the Mcol form differs greatly from the N1 which I have completed...
