It was on the fast track due to the value at the time, but the judge moved it to the small calims at the first court hearing and due to the raising of the claims thresholds.0 -
Hi,
Our flight was delayed on 15th Feb 2010 from Cancun to Manchester due to a baggage handler driving his vehicle into the side of the plane resulting in damage. Another plane had to be sent resulting in approx 17 hrs delay.
Question: Does this scenario count - damaged plane by ground crew?0 -
In short YES absolutely, just read Vaubans guide it's all in there. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

There has even been a European Court case about such circumstances - see:

My bundle goes in next week, I suspect I will not get TC's
Mine went in, TC's didn’t, one clear day before the hearing they agreed to settle and got the courts to vacate, three weeks on they finally sent the detail on the settlement - but for less than 8% of the main claim, back to getting it re-listed all over again, so watch that trick. :mad:0 -

TC solicitors are not weighmans in my case, but i will defo keep a close eye on what going. Bad show though if they don't send a bundle to you, i will mention that to the court if needed as that is not following procedure and in the interests of fair justice i will insist CPR's are followed.Check out Vaubans Flight Delay Guide, you will be glad you did....:):)
