As it's a claim for 13 people, it may well not be on the small claims track, but how you managed that via MCOL I'm unsure, unless the Judge agreed to add all the claimants at the outset of the case ?

It was on the fast track due to the value at the time, but the judge moved it to the small calims at the first court hearing and due to the raising of the claims thresholds.
  • Hi,
Our flight was delayed on 15th Feb 2010 from Cancun to Manchester due to a baggage handler driving his vehicle into the side of the plane resulting in damage. Another plane had to be sent resulting in approx 17 hrs delay.
Question: Does this scenario count - damaged plane by ground crew?

There has even been a European Court case about such circumstances - see:

Mine went in, TC's didn’t, one clear day before the hearing they agreed to settle and got the courts to vacate, three weeks on they finally sent the detail on the settlement - but for less than 8% of the main claim, back to getting it re-listed all over again, so watch that trick.

Did they actually say it would take 28 days from supplying your bank details or is this your assumption? TIA

Hi all - the full £800 compensation was paid into my account today - on time.

We worth the 9hrs of lazing about - with free meal vouchers!

TC solicitors are not weighmans in my case, but i will defo keep a close eye on what going. Bad show though if they don't send a bundle to you, i will mention that to the court if needed as that is not following procedure and in the interests of fair justice i will insist CPR's are followed.
