what do you mean by "exceptional circumstances"?
the regulations refer to "extraordinary circumstances" which refer to weather, ATC etc which would mean that the airline would not need to pay compensation as the delay is outwith their control.
What was the reason for the delay?

As previously advised in the other thread, all the info is in Vaubans guide, and a broken transponder is definitely not an EC. Don't worry about your terminology of what EC means even our friend His Honour DJ Platts, was a little confused.
You will probably not learn the true cause of the delay before TC give their defence to your case, which will only happen after the NBA, and you've started proceedings.

Morning this is what I got today!!!
Following the review, under EC Regulation 261/2004 your case has been re-assessed and I can see from the aviation report that your delay was caused by a manufacturing defect of a part we had replaced on the aircraft. Based on this information under the revised EC Regulation 261/2004, technical faults due to manufacturing defects were not affected by the court ruling and remain classified as extraordinary circumstances, therefore I am unable to offer you compensation for your claim.

So what caused the delay? What did the aviation report say ?
It's all a bit vague to me.
What they say about manufacturing defects is true, however repairs to components because of wear and tear or sudden failure are covered by the regs, and are not an EC.
You could send an NBA, start Court proceedings, then review their defence. That's probably the first time, you will get full details on what actually caused your delay.

Been over 28 days now since I applied for my compensation,
Thomascook say they are still investigating cause of delay although I have already told them they told me it was a technical fault and were awaiting the outcome of the huzar case. Obvious they are just ignoring me should I refer my claim to the caa or just take legal action or just try and be paiteint? Any thoughts welcome.0 -
