Hi all - great forum - has been much help.
After 8hr delay Palma to Cardiff in August, decided to deal with TC direct rather than Bott&co or similar to see how it went.

After little feedback from TC had this back today

"Thanks so much for being patient whilst we investigated your recent enquiry about your flight and previous claim with Thomas Cook Airlines. I am pleased to say that we have now completed the review of your claim for flight TCX7195

As you are aware, the previous investigation showed that the cause of the delay was as a result of a technical fault which was not inherent in the normal course of activity.

A recent Supreme Court decision in the case of Huzar vs Jet2.com, has resulted in a change to how EC Regulation 261/2004 is interpreted. This is the Regulation that provides for compensation payments for flight delays. The decision of the Supreme Court now stipulates that a number of technical incidents leading to flight delays can no longer be classified as extraordinary circumstances. This is different to previous guidance from the CAA and other national enforcement bodies.

Following this review, under EU Regulation 261/2004 compensation is now payable for your claim. Due to the high workload that we are currently experiencing, I want to say sorry for the delay in issuing the compensation for your claim. You will receive the compensation within 28 days and the amount being paid will be confirmed on your payment confirmation email.

I’m really sorry that you experienced a delay on your flight with us. It’s so important to us to make sure that your flight is on time and you get the best possible customer experience. Thank you for taking the time to contact us and we look forward to welcoming you on your next holiday with Thomas Cook."

    Happy Days!
Congratulations, but they are still living in the land of !!!!!!!!e and make believe aren't they! :(

  • Can only speak from my experience with TC - they have been fine to be fair.
A delay in responding due to backlog with Huzar/Jet2 case - but looks like being resolved without having to much fuss!
Others have different experiences - granted.

Looks like a few more of us are getting paid out. I wonder how long it takes for the payment confirmation email. There was 9 in our party not going to tell the others till I have the cash.

TC has already admitted liability in our case & sent us a voucher which was no use to. So I asked for the cash instead

We received an email at the beginning of November saying the money would be in the bank within 10 working days.

Then the Supreme Court made the ruling - Still waiting. Sent a chaser, but am guessing they are swamped.

Patience now looks like the name of the game!

  • There are too many threads to read about this, so I will quickly say, my party of 18 were delayed in September 2008 but we have just heard over the past couple of weeks the EU ruling, so even though we have just exceeded the 6 year time frame by a couple of months. Is there anyone in the same boat as myself and what are our chances of being compensated.

Also I was due to fly back from Las Vegas in October and I received a text the morning of the day I was due to fly back saying my connection flight from heathrow to newcastle was cancelled due to airfield restrictions at newcastle. so my whole flight including from Vegas was delayed for 24 hours. So what does airfield restrictions mean? Can I claim compensation due to this airfield restrictions?

So the text I received only stated my connection flight to newcastle was cancelled, so I'm thinking if my original return flight still took off obviously without me due to the connection being cancelled and they rescheduled for 24 hours later?
  • Yes it is a thomas cook flight.

First query, no you are out of time, nothing you can do about it.
Second query, you need to get more details about the "airfield restrictions" You could contact Newcastle airport and find out what probl;ems/restrictions they had, if any on the date you were due to fly? eh security, weather strike etc.

The second query is entirely academic though as you have no chance at all of getting compensation. So I wouldn't go to any effort.

Jedi Master, did I misread the OPs posting. I was under the impression that they were talking about a second flight? Las Vegas in October?
WAMS could you clarify? Your flight from Las Vegas was different to 2008 out of time flight?
