My flight was delayed by nearly nine hours due to damage to aircraft by airbridge. Got Court date for January and TC state they are going to defend ! Perhaps they are not aware of Seiwert v Condor ?

Indeed. Have you seen an English language version of the judgement yet?

No. Just the Google translation. The final ruling translation seems ok and is being quoted by people like EUclaim.

Enter Siewert v Condor C-394/14 then select flightlaws and in narrative you can click to see the order in German with the option to print in English. Worth looking through the other sites shown.

For the EUclaim reference go to EUclaim.co.uk then select News. Third item down.

  • I have just sent a claim for flight delay compensation to Thomas Cook for a delayed flight from Norwich to Palma Majorca in June 2012. I have sent them the Flight number, date, time, delayed time (4.5 hours) and the Holiday Booking Reference for the package holiday booked through Airtours/Thomas Cook. I have received a reply stating I need to forward them a copy of the booking invoice, boarding card or Airline ticket to ensure I was on the flight! After 2.5 years I do not have any of these. I do not have emails from that far back either. The delay affected 3 persons (all family) on the flight under the booking so could be a reasonable compensation claim for 750 Euros plus interest according to delay time and distance travelled. Will I HAVE to find these to pursue a claim? Or is it possible to request copies of old invoices from Thomas Cook under some law/regulation?
I know all the relative info for this flight as for some reason I had typed up all the Holiday details to give to my sister at the time and saved the document.
Just wondered with all the experience out there if someone can point me the right direction forward.

Time to write back the letter known as NBA, - Notice Before Action.
You briefly state that you have given all the information required in order to pursue a claim, and that you are aware that they have information on file that confirms your group as passengers, and that any further unwarranted delaying tactics will result in you issuing court proceedings where 8% interest from 2012 will be claimed.
You are basically giving them 14 days notice in order to comply with court pre action protocols.
  • Hi - First time using this so please forgive any mistakes. I have received a 'final' reply from Thomas Cook informing me that no compensation is payable for the 24 hour flight delay as the cause was a 'bomb threat'. This information completely contradicts what we were told at the airport, namely 'a mechanical fault, delaying plane as the flight crew had gone over their allowable flight time'. The flight is TCX062K on Saturday 20th February 2010. I would be grateful if anyone else had any more information as I have a feeling that they may be covering their backs (and reading this lol). :)
