I have just sent an NBA to Thomas Cook for the above flight and received a response 15 minutes later stating they will be paying compensation.

Should I ask for a cheque at this point rather than wait for a voucher?

I received an email saying they were paying on mine 02/12/14 & I replied saying I wanted cash not a voucher, there was no reply. I am waiting for my award confirmation email.

Did they say they were going to pay you by voucher?

I've read other posts saying that they were receiving cheques from TC?

No they just said I would receive a payment email confirmation & be paid with in 28 days. I had also read about the vouchers so just thought I would reply.

Thanks for your quick reply laudan

I wouldn't worry unnecessarily, you're in for success, just spare a thought for your Jet2 friends this Christmas

I see that Bott & Co now have details of the Siewert v Condor judgment (https://www.bottonline.co.uk/articles)

Today received "offer of settlement in order to avoid the cost of attending the hearing."

Sum offered is my original claim plus Court fee - no allowance for Hearing Fee or time off work to attend a hearing which was stayed to await outcome of Huzar v Jet2 request to appeal to Supreme Court.

Can I be seen as being unreasonable and wasting Court time by declining the offer ?

Thanks to all who have offered advice and guidance on my 3rd flight delay with Thomas Cook. TC paid straight away for the first two but the TCX 520k flight on 26/10/08 MAN-LCA was due to a technical fault so I ended up filing a claim against them.
I got a letter today from their solicitors informing me that TC will offer £700 which constituted €400 each for myself and daughter plus the court fee.
Am delighted that the Huzar v Jet2.com case was successful for Huzar and obviously for my own claim. A clear line drawn under this last claim which was a year in wrangling and waiting.
I couldn't have done this without your help and support
    Many thanks

Does anyone know the exchange rate to use to work out amount due, is it at time of flight, at time of claim, or current? Thomas cook have agreed to pay me and today recieved an email sending me a voucher so have replied asking for a cheque instead. The amount due is €2000 and they are offering £1660 which doesnt seem to match the exchange rate at any of the times!

Time of flight, google 'Historic exchange rates'

£1576.943 would be todays exchange rate, what was the date of your flight?
