They took it into the court room and i can only think on the basis of the flight path had weather conditions (Tunisia) BUT Atalanya NOR Bristol had weather issues, they claimed they had evidence of buying seats etc off other airlines to get people back quicker, but this wasn't included in the evidence they gave to the court.
They also claimed that they had 1 plane based at BRISTOL, which the sentence was some thing like : THERE WAS A PLANE BASED AT BRISTOL READY TO RETRIEVE PASSENGERS FROM TURKEY, it turns out it was actually coming from Pathos and it was technically based their for the summer, but everyone took it as it was at Bristol being prepared to pick us up...The judge didn't take to kindly to that bombshell lol
My solicitor is going to recommend my case be used as a case file as he believes its the first of its kind, the original flight path had weather issues but when the plane was changed etc there was no weather issues in turkey OR Bristol which was now my new planes flight path.
The weather was 3 steps back as the judge called it.

This was at Birmingham courts 11th December @ 2pm, I will receive about £600 after EUdelay have their takings etc...TBH without the solicitor picking up on them not doing enough to pick us up, ie no evidence of trying to get different airlines to help etc then this case would have been awarded to them, so fair play to him.
Thanks for all the help, I could only get it to the court stage myself and wouldn't have won the case, so in this case a company was needed to assist me further..I felt so proud afterwards and for that feeling alone its worth all the hassle, keep plugging away peopleIt's worth it.

I claimed through Bott and co for my Corfu to East Midlands flight 29/6/13. Got stuck over 5 hours. Anyway got an email today to say they are settling
will pay for next years jollies. I did write to them first but when they did the extraordinary circumstances line I thought I couldn't be bothered with the hassle so am delighted. I think I'll get around £180 back, probably would have got £300 if I'd done it myself, but a bit of something is better than a lot of nothing

Complained in June this year in relation to the above Thomas Cook flight which was due to leave 3rd December 2012
The flight was delayed for around 5 hours due to technical problems with the plane
The initial response from TC stated
'A full investigation has been carried out to find out what the cause of the delay was and we can see that the flight was delayed due to circumstances that were completely beyond our control. This investigation shows that the root cause of the delay was due to change in law.
On this occasion under EU Regulation 261/2004 compensation would not be payable'
I pointed out to them that this reply did not actually make sense!
Anyway they would not budge and I thought I might have to go to court but I received the following on 21st November
'As you know, we wanted to fully investigate your claim for your flight delay but had to wait until the Huzar vs. Jet2.com legal case had been heard.
On 31st October 2014 a decision was made by the Supreme Court. This ruling confirmed that a number of technical incidents leading to flight delays can no longer be classified as extraordinary. This is different to previous guidance given by the UK CAA and other national enforcement bodies.
We accept this new decision and we will now review all our cases in light of this recent change.
Due to the high workload that we are currently experiencing we want to apologise for any delay in coming back to you with a further update. We will try to reduce the time you have to wait to hear from us again to acceptable levels as quickly as possible.
We are very sorry that your flight was delayed. As soon as we have fully investigated the reasons why, we will be back in touch.

I would suggest writing with a NBA letter to speed things up, your case will be at the bottom of the pile I'm afraid - obviously they will deal with current Court cases as a priority.After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I have found Thomas Cook relatively straightforward to deal with. I submitted my claim the first week in November and on Friday rec'd payment into my bank.
You should consider that they most probably have a large number of claims to process, some of which will be from people just trying it on.
I found that each of my emails took about 10-14 days for them to respond to. I was always polite in my communications to them, if your claim is justified there is no need to write threatening court action. Just be a little patient.
Initially I was offered vouchers, but then having considered it for a few days I requested a BACS payment to which they readily agreed.
