  • Success re TCX473 (SFB-MAN) on 12/10/12.


    Had given Thomas Cook a final opportunity earlier this month to pay. Hadn't heard anything by Wednesday this week so prepared the court docs. To show to the court that I was being reasonable I gave TC a call and was given the stock answer that it was being considered but no timescale. Advised them I would be handing in court docs next week.


    Email today advising that compensation will now be paid within 28 days.


    It's been a slow process but there appears to be light at the end of that long tunnel!!

  • Our flight was delayed 45hrs from Barbados to Manchester 3 weeks ago. Despite being handed a letter from TC CEO Christoph Debus as we left the aircraft accepting full responsibility and promising full compensation in 14 days from claiming, TC still wriggled like a greased ferret.
    After constantly emailing them they finally sent...the vouchers!!
    This is obviously there default reaction.
    MSE to the rescue advising us that cash can be King if you just ask then a quick phone call and a BACS transfer is (allegedly!) on it's way.
    This may sound fairly straight forward but I have been shaking TC like a terrier with the above mentioned ferret in it's mouth all week:T.
    Motto...Don't Give Up The Fight.
  • could someone please tell me what number they called so I can also chase mine up? My flight was 2010 and we complained ages ago!!

    I gave them 14 days to reply to my last email but I only ever get a stock reply... I will submit to court next week as promised but I would like to phone them first so I can not bother with the application thus saving them money.

    TC already declined me but I have CAA confirmation that in their opinion compensation should be sent and that was BEFORE the Oct 31st Huzar ruling.... sheesh!!

    I would say highly unlikely, they will be swamped with claims, post Huzar/Dawson.

    I would write to the Courts, try and get the stay lifted, if you get a hearing date, you might just find that your case moves towards the top of the pile to be dealt with.

    Just as I suspected really. I initially emailed T C with the directive so it gives our case more clout when applying for the stay to be lifted. At least we're being seen that we are trying to get things resolved without having to resort to a court hearing.

    I rang the local County Court last Friday to explain our current position on the case and they informed me that I could apply to reopen the case via email quoting the case number and attaching any supporting documents.

    That email and attachment will be on it's way later this evening.

    There are some suggested replies to getting stays lifted in the Huzar thread, made initially by myself and tweaked by Batman and others, it will need further thinning down and there has been another proven suggested response here https://forums.moneysavingexpert.com/discussion/comment/67082985#Comment_67082985
