    This could be deemed a slightly stupid question but when talking about a delay does it matter whether the delay is regarding departures or arrivals or is it arrivals only?

    it is the delay on the arrival that counts...If a flight departs 3 hours and 10 mins later and arrives 2 hours and 55 mins later, no compensation

    Ah ok great thanks, flight arrived 3 hours and 5 minutes late so hopefully we will get somewhere!:beer:

  • Just to give everyone a bit of hope 4 yrs 3 months I was finally offered a voucher for £1038 by Thomas Cook acting on general advice from the web I phoned told them i didnt want a voucher straight away no probs we will make BACCS transfer so dont give up keep going.........and GOOD lUCK

    Need some advice here.
    A group of us went on a flight in April.
    It was London to Hurghada so > 3500km and not EU
    Boarding delaywas 3 hours 50 mins but we made up around 30 mins during the flight, so I think we were around 3 hours 20 mins delayed on arrival.

    Now a number of us in the group have received £504 and I believe that's a mistake.
    TC are now telling the other that's they will get E300 or £250 and I believe they are correct in that.

    However my question is - what is the situation for those who have offers for £504? are those legally binding.?

    If it has already been accepted and banked then I would be in no hurry to return the compensation paid.
    They are not asking for it back, but I do have emails saying "in full and final settlement".
    I'm seeking to find if that fully protects us but I don't believe the amounts would warrant their (paid) time pursuing us.
    If you have only an offer to pay the higher amount then the airline could rightly correct that before paying out.
    Ok, is there a law I can quote to my (less lucky) friends or is this just basic contract law? (I happen to agree with you)
  • Hello all.

    You might have seen that I posted a topic on here last week regarding my delay back from Egypt.

    In all it was 27 hours. I've claimed back from my insurance and applied to Thomas cook for compensation under the eu legislation that's given.

    They have contacted me back to say that because it was as safety issue they aren't paying out compensation.

    Where can I stand on the fact I had a 27 hour delay, wasn't offered phone calls emails or faxes and received shocking information in resort with next to nothing in updates.

    Please help!
