After 18 months of intermittent contact TC have made an offer of compensation for our delayed flight 17th Oct 2012 TCX2108 to Larnaca.
A quick call to request cash rather than a voucher and BACS transfer sorted.:j
If you're still battling with them, keep going, there is light at the end of the tunnel. I resubmitted my claim via the newish Web form and had a reply and offer within a week.0 -
we were told at the time that it was due to another aircraft going tech so they used OUR aircraft to cater for that route and we had to wait for another aircraft to come to us...that was what I was told.0

Well, if that's the basis of their defence, I can't see it succeeding. suject to what comes out of the Huzar case, even the technical issue wouldn't be EC. I'm not that clear on the whole "knock on" question but I don't see that would apply as you were eventually flown on a different plane.0 -
Hello, I was delayed 12 hours last April . Was flying back from Dlaman to manchestr on a thomas cook flight, Flight TCX2735. It landed on time into Dalaman, but we were advised that the pilot was ill and unable to fly back. Apparantly he had vertigo! He was however fit enough to jump on the next flight back out of Dalaman on a MOnarch flight two hours later, leaving us to wait for a new pilot to arrive on a flight from Scotland 10 hours later. Would pilot sickness count as extra ordinary circumstances??? Any help appreciated. Sue

hi I take it you got fobbed off from them several times over this period. We had 20hr delay from Belfast to Larnaca in Sept 2012 and have got the usual ECs and got random email from CAA last week saying that they won't do anymore (not that they did anything in the first place). I know....CAA are useless but I'd already contacted them before consensus said I shouldn't bother.
Am curious if you just kept pestering them or what sort of level of contact you had with them please?
Did you put your original claim via the online bit ? When you did resubmit, did you select new or follow up?
Just thinking about re-doing everything again....

Why would you start over again in the expectation of a different result, you crazy duck?!
It is most unlikely that the airline will change its mind, and there is only one way to ensure you get your compensation ...
That said, unless you are at the 2/6 year cusp, you might as well sit out and wait for the Huzar verdict (assuming that your delay was technical in origin).0 -
Hi all,
I'm looking for advice on a little kafuffle I'm currently experiencing with Thomas Cook, which goes as:
Our flight from Manchester (UK) to Sanford (USA) TCX472 on 12th July 2013 was delayed by approx. 7hrs. Out of pure frustration of lack of any information during this period, we decided to make a claim against the company on our return. Initially we went through all the loops being requested by the them, but they would not give any information as to the cause of the delay. So we contacted the CAA for their ruling, again after many months of dialogue the CAA ruled that Thomas Cook was liable for the delay and to which Thomas Cook rejected the findings.
Based on the ruling from the CAA we contacted a solicitor (friend)who took the case to TC; Thomas Cook have ignored these letters completely and so we are a little in limbo as to what to do next?
My queries are:
- Is it customary for large companies like TC to ignore legal letters?
- Is the next process of small claims proceedings a viable option?
- Why would TC ignore the findings of the CAA?
I hope someone will be able to help on any of the above and thanks in advance.
