My queries are:
- Is it customary for large companies like TC to ignore legal letters?
- Is the next process of small claims proceedings a viable option?
- Why would TC ignore the findings of the CAA?
a) Yes
b) Yes
c) Because they can, with impunity.0 -

It's not 'a viable option', it's almost certainly your only option if you want to get compensation.
A positive "opinion" from the CAA is better than a negative one but, as P Doff says, in terms of getting compensation, it's not worth the paper it's written on. Ridiculous, but true.0 -
Hi....just to give folks encouragement, we've just received approx £1200 by BACS for a GLA to Paphos flight from Oct 2010. Was a struggle but got the compensation so hang in there.
Many thanks to MSE for the template!0 -
Hello
I thought I would just post a quick note to say that claiming for flight delays does work! I was delayed for a number of hours when on a Thomas Cook holiday a few years ago and after a bit of hassle in searching for flight numbers and customer numbers etc I received an email today telling me that my claim has been successful and that a voucher for the value of £668 was on its way.
Quick query though, is a voucher for money off another holiday the way that these claims are normally settled or is that the easy option for Thomas Cook? I ask as I would really prefer the money rather than be tied to them for another holiday and with plans to marry my partner the money would be more useful.
Can anyone offer some advice? Should I take the voucher and run or try for cash settlement instead?
Thanks in advance

Well done!
You could have used the Thomas Cook thread, rather than start a new one.
The 'vouchers v cash' question is covered extensively here (use the search facility) and, indeed, in the Regulation itself.0 -
Hello all.
Just to update on my situation, my family of 3 went on holiday to Kos last July, on returning our flight was delayed by 3 hours and 5 minutes due to damage of the plane by the person who drives the steps up the the doors.
Anyway, about 4/5 weeks ago I sent an email off to TC requesting the compensation i felt we were due, about a week later I received an email offering me a voucher for £50 per person, i emailed back rejecting the offer and again requested the full amount, this time mentioning 261/2004.
Yesterday afternoon I received another email, this time offering me a voucher for £1005. I called them and informed them I would like the cash value, they took my bank details and told me the cash would be in my account within 10 days. Job done!0 -
I referred a case to the CAA back in April 2013 after TC fobbed me off, and have heard nothing yet! I know they must be busy, but 13 months is ridiculous! Chased up today and was told they will respond in a week.
TC told me that the technical fault on their aircraft was "much like you running out of petrol in your car"!0 -

Running out of petrol in a car is an operational decision made not to call in at a petrol station and fill up. Hardly beyond the control of the driver! The above is just my opinon - which counts for nowt! You must make up your own mind.0 -

Very strange choice of analogy as presumably that would definitely be their fault! I really wonder what training they give the poor so-and-sos who they have dealing with claims. (I'm thinking somewhere between none and very little.)0 -
TC really so full of the proverbial. Does make you wonder who actually runs the airline competently.
Running out of petrol in my book is ignorance and negligenceIf you're new. read The FAQ and Vauban's Guide
