Maxpax: I understand your logic. I think that, whatever Wallentin says, in flight technical emergencies are probably trickier (though not impossible) to win in court. You would likely have to show a problem with maintenance, which is hard to do. My advice is to sit tight and wait for the Court of Appeal to look at the Huzar judgement in May - if it's upheld, you'll have a way easier time of it if you then take it to court yourself.0

I have received a reply from TC who are still adamant that the delay I suffered was an extraordinary one and that it is only the opinion of the CAA that I was entitled to compensation. I have now registered with the small claims court and paid my £60, could anyone tell me what happens next and could this cost me anymore than the initial £60.
I know that the letter from TC is a standard reply hoping I will drop my claim but the last line of 'we wait to hear from your appointed legal representative' does leave me wondering wether I have made the right decision.
I have looked through a lot of this thread but can't seem to find any comments regarding the above has anyone had experience of the small claims and what it entails and if in anyone's opinion if the CAA finds in your favour am I doing the right thing in pursuing the claim

I assume you have not tried reading this thread.....if you go to the "search this thread" and type the words "booking reference" you will find a number of posts asking the very same question
also search on "SAR" - where you ask Thomas Cook for all the info they have related to you0 -

"I will request our finance team process the compensation in the sum of £#### based on the rate of exchange on date of your delayed flight."
...my delayed flight was in 2007 when the exchange rate was about 1.45 Euros to the pound, today it's about 1.20 Euros to the pound. In real terms, it means they are trying to get away with paying me about £800 less. I've asked to be paid in Euros, but what is the rule here??0 -

I think two things:
1. It is legitimate (in fact proper, I understand) to use the rate of exchange at the time of the delay
2. If your delay was in 2007, the airline don't have to pay you anything: and I'm surprised you have not been told to take a hike. If they did, you'd be out of time to force their hand.
All of which is to say I would not make a fuss about euros or anything else - just give them your bank details before they realise their mistake!0
