Flight delay and cancellation compensation, Thomas Cook ONLY

    Checking the papers before sending them back to court, and like MCSAVE (poster 14/02/13 7.46 PM), they are claiming the correct defendant is Thomas Cook Tour operations Ltd. not Thomas Cook Airlines as I indicated.
    Flight involved was TCX6239 which appears on Flightstat as Thomas Cook Airlines, have several letters from TC mentioning TC Airways, including one dated 11/12/12 from the same litigation exec. as has signed the court papers for them. Am I being paranoid or is this some dirty trick?

    Just an update on this particular delay (TCX7174) which I've been pursuing for my parents - my folks have now had a letter from TC still insistent on the cause being exceptional and then continuing with words to the effect that 'we should think of the planes like our own cars, occassionally they break down with no warning and so need maintenance' - my mum was not happy with this at all - I'll get a copy of the exact wording tonight. :mad:

    Many of us on this site have received this letter, I have written another 2 to Thomas Cook and I received a different reply every time.
  • They won't get away with it for much longer tho' will they, since they must provide at least an outline defence to your claim or your claim will otherwise be accepted by MCOL.

    You could ask them to provide the cheque now since that inbound flight is not in dispute.

    Will I hear from MCOL or them? Just printing my emails out,,I'm upto 30 pages!! :(
  • Hi after a follow up email to TC I recieved the following reply.
    The flights were part of a package holiday booked through Direct Holidays (part of TC group). I thought that my compensation claim was through the package operators not the chartered airline?

    I have recently received your e-mail regarding your flight delay. As I was assessing your case, I can see that it was not a Thomas Cook flight that you were on, for any compensation claims under Regulation 261, you have to go to the airline that supplied your flight, in this case Excel Airways.

    As of September 2008 Excel airways entered into administration so any queries regarding money owed or compensation due would have to go to the Civil Aviation Authority. You can contact them by going to https://www.caa.co.uk.

    Looks fine but how many times have you written to the airline giving them notice of court action?

    This is the second and last chance. The letter before action I sent stated that they needed to cough up the compensation or prove that the EC existed by telling me what it is.

    The funny thing is that after doing some digging I found out there is no such thing as a high speed bleed valve on a Boeing 757-200. There is a high pressure bleed valve but they never mentioned that.

    I would love this to go to court if that is their defence. An extraordinary issue with an imaginary part. :rotfl:

    They must be. There is no such thing as a high speed bleed valve on a Boeing 757-200 as far as I can tell.

  • Apologies if this is in the wrong place, I've never used a Forum before!
    I have used the template for claiming from Thomas Cook, and they have replied that they need either the confirmation invoice, ticket booklet or boarding cards to prove we were on the flight. The delay was in 2009 and I don't have any of those now. I am sure they must have access to flight records to verify that we were on the relevant flight, but obviously have a vested interest in being obstructive in this!
    Any advice/ information anyone can offer on either how I might get hold of the info, or any legal obligation TC might have to help would be appreciated. Thanks
