    MCOL says:
Providing a valid address for each Defendant.

You need to provide a full address within England and Wales for each defendant, including the post code. This is known as their service address. MCOL does not have jurisdiction outside England and Wales, claims issued to addresses outside England and Wales will be invalid.  if the defendant is an individual the claim must be served to their usual or last known residential address  if the defendant is an individual using a trading alias then the claim may be served to their usual or last known residential address or their place of business. If the defendant is an organisation then the claim may be served to their registered office or to the address where you have been dealing with them

I would ALWAYS send any court documents to the registered head office which is Peterborough although Thomas Cook will probably tell you otherwise.

Thanks for the info chaps, i have had all my letters from customer relations, bradford, goodwin st. Perhaps now I should send my NBA again to head office a deal direct with them. Another 14 days wait perhaps, and the the MCOL to that address to save any misunderstanding. I would persume my NBA would need to go to the Legal dept at peterborough?

Wouldn't bother sending it again. It only gives them the chance to ignore it twice.

I don't think I will send my NBA again, they have had enough time and chances. i have worked my claim out + intrest @8% + the conversion euro rate at the time ready for MCOL. The law is the law and that's what matters, not some bodged up excuses by the CAA/Enforcement bodies and what have you. People power is required to get the CAA to enforce the law without restrictions or them ASKING the airlines what they though was EC's, to put in the guidelines, i have the written proof of that, research is a wonderful thing.
I know what my delay was and have proof of that too, I have researched that and it's not EC's as the issue is more common that you think 50+ aircraft per year have the issue. I am not mentioning just yet what it is as TC may be watching.

    Hi guys

My tablet won't allow me to search the thread so thought I should write up my experience - would be very grateful for any advice please.

We had a valid claim after a seven+ hour delay on route to Turkey this year.

I read the form notes and followed the process (than you everyone for the excellent help on here).

Thomas Cook have been excellent, it must be said, and have offer vouchers or bank transfer. No arguments or fuss and only a two week wait. One element I would like people's thoughts on please.

There we five of us - two adultd and the kids, the youngest of which I think was indeed priced on a special deal (might even have been £1 kids, will check when back home from work travel). TC have agreed to style for four of us, not the special price deal child ticket. I think this is mostly fair but before I accept their offer, I wondered what had happened to others in the same situation? For the record, TC have offered £347 per person.

    Many thanks in advance,

    The wookie :money:

I will be issuing a MCOL soon. I was just going to claim the €600 for a 23 hour flight from Canada but it looks like I should be adding other expenses too ?

When is interest calculated from ?

We were on this flight...wasnt it 31st july (supposed to be 6.15 am)? We sent thomas cook a letter as soon as we got back.. had reply advising they wouldnt be paying compo due to technical difficulty. Did you get the letter at check in to advise it was due to operational circumstances? However my second letter more or less said I will be taking this further but they are standing their ground still claiming technical fault. I havent got time to pursue this myself so have contacted no win no fee ( bott and co) and left it with them.. to date they have just sent tc first letter. I will keep you posted as if you can settle it with tc directly you will avoid paying fees out to no win no fee.
yes thats right and we did not get a letter at the desk just told of the 4.5 hour delay, they have not replied to me yet , i have just emailed again today to ask for their response and an update, will post on here if i get anywhere
