Markie: You need to be patient. I started my claim in October of last year, began legal action in early February, and will be in court next week. And that's doing it all myself. When did you expect to get a result?

I must have been one of the first following Sturgeon last October ... same answer to both questions ... 7 months but very few court claims in the 'early days'.0 -
This is my first post.
Flight TX1744 Gatwick to Antalya 21st Sept. 2012 was delayed by 4hrs.25 minutes. I have written to Thomas Cook a few times, but first on 9th May this year asking for the relevant compensation and enclosing all paperwork. I won't bore you with the details but suffice it to say that they have come up with two different Extraordinary Circumstance excuses with different case numbers. I also wrote to the CAA who have now told me that all complaints are being referred back to Thomas Cook to be looked at again. I have subsequently written to Thomas Cook twice more with no replies. I have asked them to give me detailed reports on their Extraordinary Circumstances excuses to no avail, no reply. In my last letter, I gave them notice that I reserved the right to take them to the small claims court without further notice. Can anybody give me an opinion as to whether I have now done enough to try to make Thomas Cook reply, before I take Court action. Thanks a lot in advance.
Hi Maggiejr, I was in Antalya waiting for that flight! Our plane returned (TX1745) over 4 hours late to Gatwick and have been fobbed off by TC claiming an EC. What reason(s) did they give you? My solicitor had just filed for a default judgement against them as they seem to have ignored the court papers being served on them. PM me and I will keep you up to date of what happens. You were better off being stuck at Gatwick. We had to wait around at a hot and sticky (and very expensive) Antalya airport for over 8 hours!0 -
T C have finally filed there defence it's nearly 3 weeks late from the cut off point set by the court and they are claiming I don't have a private law cause of action and use Graham & Anr as there point in law as I'm claiming 261/2004 not a civil claim for damages I don't get it ?0

Corfu to East Midlands (26 August 2013) 6.5 hour delay
Just spoke to my House Insurance provider about claiming on the Family Legal part of the policy to follow up my claim since Thomas Cook have decided not to respond to my email/letter about the explanation of the "circumstances of a technical nature". I was directed my to the complaints part of the CAA website and they told me when I get a response to ring them back.
Started filling in the form only to get the message that the CAA can only help with flights departing the UK not arriving in the UK. Grrrrrrrrr!Cashback earned

I've just recieved an email from Thomas cook the technical problem (faulty master start switch) was not found during routine checks they say if it was they would not be defending the claim0

TC are informaing the Courts that Bradford is now the address
All my letters to Bradford returned, did get a response within 2wks to email though, relations.customer@thomascook.com

Thats not entirely true, it depends where the flight leaves from. Ours left from Antalya, Turkey and that falls under the CAA. Having said that they are about as much use as a condom machine in the Vatican.0
