Today was the day I thought we would settle this - wrong! TC turned up represented by a lawyer and two witnesses. Case was adjourned, TC claiming that I had no right to bring the case to the court and the court has no right of jurisdiction to rule as per Graham & Anor -v- TC. Flabbergasted is an understatement and all this for 600 Euros. Appreciate any experts on here's assistance on this - new hearing unlikely to be before Christmas!

My post of yesterday deals with this point: http://forums.moneysavingexpert.com/showpost.php?p=63246122&postcount=3699.

First two paragraphs.

Did they not raise this in their skeleton argument previously? What did their preliminary defence say? What did their bundle of documents shared with you presumably a fortnight ago say?

TC really are getting desperate aren't they?
Shocking tactics. I trust (but have little hope) that the judiciary see through this sham procrastination defence activity and deal with TC accordingley.

Shocking tactics from a shocking company that knows nothing at all about customer care. Still a lawyer and a couple of witnesses on what will prove to be a wasted journey to a distant court to try and save 600 euros probably helps explain their precarious financial plight, :rotfl:
• I was waiting to return to Glasgow too. I have filled in T/C form online and was told two days later that no compensation was due as it was a unforeseen circumstance that the aircraft had a technical problem. I have contacted CAA and also had a response saying that I have to get in touch with the NEB in Greece as my flight wasn't from the UK!! This is getting harder but I will contact them and let you know how I get on. I just hope they can write in English!
Also does anyone know the registration number of the aircraft that should have been flying that day 03/09/13 16.00 hrs Heraklion to Glasgow as I can't find it. Thanks

I'm looking for some advice on the outward leg of this flight. My parents flew from Glasgow to Heraklion Crete on Tuesday 3/9/13. As with the return flight that Gail mentioned, initially they were told flight was 3hrs delay then this was updated to 8 hrs.

They've used the flight compensation form on the Thomas Cook website and surprise, surprise, the delay on the flight was due "technical problems" - i.e. no compensation is due. However, one member of staff at Glasgow Airport let it slip that the plane due to be used for the flight, flew to Gatwick instead to replace a broken plane there.

Is there anyway to verify this or anyway to get specific information about the "technical problem" that prevented the plane allocated to the flight from leaving Glasgow on time? (i.e. tie them up in specifics so if we go to the CCA or further, they'll have to admit that the problem wasn't with the plane at Glasgow)
• Having originally been offered a voucher valid to be used by May 2014 have been requesting either an extention of date, so can be used against August 2014 holiday, or a cheque to be used with another company, I can, with a smiley face, confirm that I have just received a voucher valid till May 2015 for £1404.00.

It has taken a while but eventually got there. Address I used was Peterborough, and email was relations.customer@thomascook.com Attn: Paul Stubberfield.

Good luck to the rest of you, and thanks for the forum help.:T:j
• Hi, I would be grateful if anyone can confirm which is the correct TC company address to enter on the MCOL form. I think it may be the Peterborough address? although I have seen other addresses referred to on the forum.
Thankyou

I sent letters to Bradford and Peterborough, only Peterborough received so suggest you use that one.
• This is my first post.
Flight TX1744 Gatwick to Antalya 21st Sept. 2012 was delayed by 4hrs.25 minutes. I have written to Thomas Cook a few times, but first on 9th May this year asking for the relevant compensation and enclosing all paperwork. I won't bore you with the details but suffice it to say that they have come up with two different Extraordinary Circumstance excuses with different case numbers. I also wrote to the CAA who have now told me that all complaints are being referred back to Thomas Cook to be looked at again. I have subsequently written to Thomas Cook twice more with no replies. I have asked them to give me detailed reports on their Extraordinary Circumstances excuses to no avail, no reply. In my last letter, I gave them notice that I reserved the right to take them to the small claims court without further notice. Can anybody give me an opinion as to whether I have now done enough to try to make Thomas Cook reply, before I take Court action. Thanks a lot in advance.
• Yes you have been fobbed off enough, I would send a LBA (a letter before action), but give them a specific length of time to respond 14 days is the norm. There is a good template letter in the FAQs
