    Manchester to Egypt Jan 2012

The flight scheduled to go to Hurghada was delayed 1 hour then delayed further (due to dropping of an engine part for another craft), before taking us to our destination. We arrived at the hotel too late for a meal

It was a package with Thomas Cook using Airtours Airlines. Who do I complain to and are we entitled since we weren't three hours tlate taking off, but experienced delays due to being diverted.

    Many thanks
  • Contacted the CAA today and they told me to fwd all correspondance i have sent them and the decision letter they have sent, Is there anything else i should do in the meantime?

    thanks in advance
  • I would have thought that in a group of this size one of the party would have access to legal expenses cover under a household contents insurance policy. Use that route to make a claim for that person/family and once judgment obtained the others make the same claim directly on the airline.

Hi Centipede100 - apologies again for the cross posting!

Can you reccommend a legal team that has experience in this field?

You should start a company handling people's claims!
  • Hello, I was delayed 12 hours last April . Was flying back from Dlaman to manchestr on a thomas cook flight, Flight TCX2735. It landed on time into Dalaman, but we were advised that the pilot was ill and unable to fly back. Apparantly he had vertigo! He was however fit enough to jump on the next flight back out of Dalaman on a MOnarch flight two hours later, leaving us to wait for a new pilot to arrive on a flight from Scotland 10 hours later. Would pilot sickness count as extra ordinary circumstances??? Any help appreciated. Sue
  • Centipede 100, could you please pm me if you have any recommendations for legal tteams to handle this thanks. Sue
  • Think again! Then check the FAQs where TC's registered office address is linked.

Waste of money going recorded delivery for the purposes you want. In legal terms and if it came to a court case you only have to prove you posted the letter to the company via first class mail, it is then deemed as served 2 business (working) days later.
Point taken with address Centipede. Thanks.

As far as correspondence with the company is concerned I've gone down the route of certificate of postage when I sent my first letter. TC denied receipt and although I have a R of P, I would have to pursue Royal Mail and have far better things to do with my time than argue with another party. For the sake of £1.55 for first class recorded that's the route I will take. Should it go to small claims court stage (which I expect it to) then would it not be the court issuing any paperwork to TC? - not sure as I've never had to push that hard.

Learning all the time though and am not afraid of accepting advice.

I hope anything I post is of use to others whether they learn from my success, failure or mistakes. Nobody is perfect

I think the only thing they are going to listen to is a court claim now.
Do you think i should go down that route for the reason they gave?
  • I would just like to say thanks for all the help from people on here. Raised my complaint with Flythomascook on 8th Jan 2013 after just over a 4 hour delay from Turkey in 2012. Got a letter with a voucher yesterday and called up today to ask for the money. They are sending out a cheque today:beer::beer::beer:

Again, many thanks for all your help
  • Hi all, i sent my complaint/claim to an address in Bradford, and now noticed that the address on the FAQ,s is differant. Do i need to re-send.
  • Hi, I'm new to the forum and apologise in advance if i'm asking something that's staring me in the face! I've already typed up one letter to Thomas Cook for a 4 hour flight delay in 2009. I looked at all the FAQ and found all the relevant flight details in emails and on Flightstats ect. However i was also delayed on a Thomas cook flight in November 2008. I have the flight details and flight number AND booking number yet i can't get the details on Flightstats. The flight was TCX109L from Dalaman to Gatwick. When i look up the details to double check it is that flight (Have flown a lot with them and had about 4 BIG delays) the site is saying that its from another airport (in Eygpt i think).
Is there any other place i can check what the flight arrival time was? Many Thanks in advance...things have been tough recently and any compensation will be a blessing x
