    Hi

Any thoughts appreciated do I proceed straight to 14 day letter of court action?

Yes, 14 day NBA then straight to court, any other path now is a waste of time. They just play these games to put people off.

Someone help me unsure if what to do I've just called mcol (judgement was issued last week through default and Thomas cook notified the court of a change of address the day after which makes me think they are going to ask for it to be set aside ) they have not done soon yet unsure if I should move onto the next stage a which is a warrant what would you do put a request for a warrant or just wait dont want to waste money doing this if they are just going to get it put aside ???

I think you should wait a little longer. I'm sure you only issue the warrant after the judge has ruled in your favour and TC refuse to pay if I remember correctly.
  • Mcol said I can do it anytime would you wait a bit longer then mcol don't do anything now unless I tell them to apparently

I would get in touch with the airline directly and ask if they require your bank details or will they be sending a cheque. That ought to flush 'em out. Call them if they don't reply to email.
  • That's what I was going to do what would you put in the email don't want to come across sounding stupid
  • Also do you have an email address an Upto date one ?

  • I have hit a brick wall with Thomas Cook and they are not budging from their decision. I did expect this but wanted to ensure I had pushed that avenue as much as possible.

I have referred this onto the CAA, which I know a lot of people are saying is a waste of time but I wanted to follow the steps should it go to a legal case.

Can anyone advise what clout the CAA's judgement has been for court cases. If they side with Thomas Cook, would that impact my chances in court or does the legal precident already set over-rule that

For info, it is corrosion to the under carriage that grounded my flight. This to me does not sound extraordinary so I think there is a good case.
  • as corrosion isn't something that just occurs out of the blue, it tends to happen over the course of several weeks/months and hardly extraordinary.[/QUOTE]

Thanks, that's what I was thinking. The NEB list of April this year (number 26) seems to be what Thomas Cook are using as backup.

Small claims court it is then!
  • Called TC they won't speak to me as it as been passed to there legal department so sent them an email with the email address she gave me
